SALUM SALUM LUBAWA and 175 other applicants are among the occupiers of various parcels of land located at Kimara and Matuga Street, Kawawa Ward, Mlandizi Township within Coast Region. Sometimes in February, 2023, the respondents threatened to demolish the applicants 5 houses in execution of the order of the District Land and Housing Tribunal for Kibaha in Misc. Application No. 176/2022. In response to the alleged demolition threats, the applicants rushed to this Court and filed the instantaneous application on 13th February 2023. In the said application which was made under section 79(l)(a) & (b) of the Civil Procedure Code, [Cap.33 R.E 2019], the applicants are seeking for the following orders: " (a) This honourable court be pleased to call for the records of Misc. Land Application No.176/2022...and revise the proceedings and decision/order thereto dated l&h December,2022... (b) Costs to follow events. (c)Any other orders as this honourable court may deem fit to make" In response to the application, OMARY KADRY (1st Respondent), MWENYEKITI WA MTAA ZEGERENI (2nd Respondent) and ADILI AUCTION MART LIMITED (4th Respondent), filed a joint Counter Affidavit. The 3rd respondent one BARTAZAR SIMEON could not enter appearance 6 nor could he respond to the application despite being duly served. In the circumstance thereof, the matter proceeded in the absence of the 3rd respondents. At all the time, the applicants were represented by Mr. Benito Mandele, learned advocate, the 1st and the 2nd respondents were represented by Mr. Ferdinand Makore, learned advocate while the 4th respondent, enjoyed the service of Mr. Denis Maringo, learned advocate. It should be noted that in the course of determining the application, the joint counter affidavit was struck out after having been found defective. In that regard, when the matter was called for hearing, the 1st, 2nd and 4th respondents were given time to address the court on matters of law only. Having heard the rival submissions from the learned counsel for all parties, I was prompted to peruse the records of the District Land and Housing Tribunal for Kibaha in Misc. Application No. 176 of 2022. My perusal realized that Misc. Application No. 176 of 2022 was an application for execution of the decision of the Ward Tribunal for Visiga in SHAURINa. 145 of 2008. I also noted that, the proceedings in Misc. Application No. 176 of 2022 of the DLHT for Kibaha and SHAURI Na. 145 of 2008 of the WT for Visiga, were the subject in another Application for Revision No. 12 of 2023, that was before this Court. 7 I further noted that this Court delivered its Ruling in respect of Application for Revision No. 12 of 2023 on 13th June, 2023. In the said Ruling, the Court quashed the proceedings and the respective orders in Misc. Application No. 176 of 2022 of the DLHT for Kibaha and the proceedings and the decision of the WT for Visiga in Shauri Na. 145 of 2008. Since the present application seeks for revision of Misc. Application No. 176 of 2022 of the DLHT for Kibaha, which is no longer in existence, this application becomes a white elephant. In the premises, the application at hand is no longer valid, as the subject matter of the application does not exist. From the foregoing, I have no option but to strike out the entire application. Each party to bear its own costs. 8
