04
Questions and positions
Legal issues
- 01
Whether the District Court followed proper procedure in enhancing the sentence and ordering compensation
- 02
Whether the appeal to the District Court was time-barred
- 03
Whether there was evidence to support the order for compensation of 52½ bags of maize
Party arguments
- Applicant
- The procedure was bad in law; the District Court should not have entertained the appeal as it was time-barred and introduced new issues; there was no evidence substantiating the compensation order for 52½ bags of maize.
- Respondent
- The appeal was not time-barred; the appellant continued to trespass and cultivate the respondent's land; the appeal was due to dissatisfaction with the fine imposed.
05
Court’s reasoning
Legal principles
- 01
General appellate procedure
An appeal is limited to issues dealt with in the lower court and cannot introduce new causes of action.
- 02
Criminal appellate practice
Proper procedure must be followed in criminal appeals, and enhancement of sentence must be based on matters adjudicated in the lower court.
06
Ratio, limits and disposition
Ratio decidendi
The District Court erred by entertaining new issues not adjudicated in the lower court and by enhancing the sentence and ordering compensation based on extraneous matters; the proper procedure was not followed.
Obiter and limits
- If the appellant or his agents are still occupying the respondent's land, the respondent is at liberty to initiate a fresh criminal action.
- Compensation for proven losses may be ordered in a properly instituted proceeding.
- A custodial sentence is recommended for repeated disobedience of lawful orders.
Court disposition
Appeal allowed
- Sentence and order for compensation set aside
- Appellant to be released forthwith

it was due to the 'insufficiency or inadequacy of the sentence, the respondent would h:.we i.;aid so• But it appears that he appealed to the District C£lliHn~:'ter seeing the_ ~ppellant trespass into his land and gr·~v maize/3½ acres more of his lfmd. If that was the case'then the right step was not to appeal to the District Court but to have the appellant charged again:,._ for disobedience of a lawtuJ. order; He could do this either in the same Primary Court or even in · the District Court'; But there cannot be an appeal with a view of moving the appeal Court to act against.a person who has committed another disobedience of a lawful order;i The appeal by its nature is limited to issues which were dealt.with in a lower court and not an /,., appeal concerning new issues. ln this case if the appellant had once again trespassed into the respondent 1 s land, the correct action to take is the same sort of action like the one which was taken when the appellant entered into the respor.a.ent 1 ~ land and took½ acre contrary to the judgment of the Court in the civil case'~ For the above reasons I agree vd.th ~s. Wamu~a that the procedure followed was wrong and contrary to the law: It would appear from the judgment of the District Court that the reason why the appellant was given a -·custocl,ial sentence waa because he had again disobeyed the order of the Primary Court in the
Civil suit'~· .Even if there was an appeal against sentence by the respondent, . the reasons for enhancement of the sentence were extraneous·~ I therefore allow the appeal set aside ·the sentence and the order for compensation given. The appellant should be released forthwith·~ One last word, if the appellant or his agents or relatives are still occupying the land which has been held to belong to the· respondent or if the appellant ocatWied. 4 ae-rei;: o-1' +.r.iQ rg:pond.en\ as the respondent was el.a1llUn.g in the·appeal in the District Court, this judgment does not stop the r,?spondent in initiating a criminal. action as he did for the first tii.te when the appellant was fined shs·~2,000/=; Even compensation fvt' whatever is proved to have been taken out of the respondent's land may be ordered.
