MSAFIRI, J The applicants have instituted the application seeking for this court's leave to file Application of Prohibition against the 1st and 2nd respondents herein above from enforcing unlawful eviction against the applicants and conducting land survey done at Kibaha Town area. The application was filed under the provisions of Section 2(3) of the Judicature and Application of 4 Laws Act, Cap 358 R.E 2019 and Rule 5(1) and 18(1) of the Law Reform (Fatal Accidents) and Miscellaneous Provision (Judicial Review Procedure and Fees) Rules G.N No. 324 of 2019. The application was supported by an affidavit of Charles Ndaki Buzwizwi, Advocate of the applicants. The application was served to the respondents who filed their counter affidavit which was deponed by Denis Kahamba Festo, the Principal Surveyor of the 1st and 2nd respondents. The respondents also raised preliminary objections as follows:- i. The Application is incompetent for being supported by an incurable defective affidavit which is sworn by an advocate representing the Applicants on matters which are outside his knowledge. ii. The Application is bad in law for lack of sufficient description of the property in dispute. Hi. The Application is untenable for being premature as the Applicants have not exhausted available remedies. iv. The Application is defective for containing defective jurat of attestation. On 05/3/2025, the court ordered the hearing of the raised preliminary objections to be heard by way of written submissions and set the hearing schedule. The submission in chief was to be filed by 12/3/2025, the replyM 5 submissions was to be filed by 19/3/2025 and rejoinder if any was to be filed by 24/3/2025. The application was set for mention on 25/3/2025. On that date i.e. 05/3/2025, the 2nd applicant appeared in person and on behalf of the rest of the applicants and prayed to be served with the counter affidavit and notice of preliminary objection. The court made order to the effect that the applicants be served with the counter affidavit and notice of preliminary objection. On 25/3/2025, the matter was for mention for the purpose of ascertaining whether the parties have complied with the schedule order so that the court could fix the Ruling date on preliminary objection. The parties were both present in court whereby the applicants were being represented by Mr.Richard Ndaki, learned Advocate while the respondents were represented by Ms. Pauline Mdendemi, Senior State Attorney. Mr. Ndaki informed the court that the applicants prays to withdraw the application for a reason that the 90 days' Notice has expired and the Application has been overtaken by events since the applicants have already instituted their main case in court against the respondents. I 6 Mr. Ndaki told the court that the 90 days' Notice has expired since 24/10/2024. Ms. Mndendemi argued that it is the rule of procedure that the applicants cannot withdraw the Application while there is a preliminary objection against the Application unless the applicants concede to the raised preliminary objections. Ms. Mndendemi pointed that since the preliminary objection has been filed and served to the applicants, the only remedy there is for the court to strike out the application. Ms. Mndendemi added that the applicants were aware that the 90 days' Notice has expired but they did not inform the court about this status or pray to withdraw the Application when the parties appeared for the first time in court on 17/2/2025. She prayed to the court to strike out the application with costs. According to the court records, this application was filed in court sometimes in 2024. The digital filing shows that the application was finally filed on 20/11/2024. The application was set for mention on various dates. On 12/12/2024, case was mentioned in court but only the applicants appeared being represented by Mr. George Timoth, Advocate who was holding brief of Mr. Charles S. Ndaki, Advocate for the applicants. The respondents were absent. The applicants did not address the court on the issue of 90 days' Notice expiry. On 17/02/2025, again the Application was set for mention. Parties appeared whereby for the applicants' side appeared the 2nd respondent Mariam Victor Kufakunoga who appeared in person. Mr. Revocatus Thadeo appeared for the respondents. The respondents prayed to file their counter affidavit, and the court granted leave to do so. The applicants were silent on the fact that the 90 days' notice has expired. The respondents went on to file their counter affidavit, raised notice of preliminary objection and the court set hearing schedule. All these progressed with the applicant's awareness, while knowing all the time that the 90 days' Notice has expired so the Application was no longer competent before the court. I find this to be an act of gross negligence on the part of the counsel for the applicants and an abuse of court process and wastage of this court's precious time. As correctly observed by Ms. Mdendemi, the applicants cannot come and pray for withdrawal of the application while there are preliminary objections which have already been partly heard since the respondents have already filed their submissions in chief in support of the raised preliminary objection. A<l |, 8 In the circumstances, the court draws an inference that the applicants have conceded to the raised preliminary objections, making the application incompetent before the court. The consequence of an application being incompetent is for the same to be struck out. I hereby struck out the application for being incompetent with costs. A. MSAFIlU JUDGE 25/3/2025 9
