The right to institute a fresh suit under Order XXI rule 62 of the Civil Procedure Code is not subject to conditions beyond those stated in the rule. The appellant, as a losing objector, was entitled to institute a fresh suit to establish his rights, and the question of locus standi required factual determination at trial, not summary dismissal. The High Court erred in striking out the suit at a preliminary stage.
