Ratio Decidendi

The Plaintiff, having undertaken to provide security services, was contractually responsible for losses due to theft during the period of engagement. The Plaintiff is liable to indemnify the Defendant for the proven losses, subject to the contractual cap of either THz 50,000,000 or 70% of the value of the loss, whichever is less, and must process insurance claims for the Defendant. The Defendant's counterclaim for compensation is allowed to the extent of proven losses, and the sums may be offset against outstanding invoices.
