Ratio Decidendi

The transfer of the application for extension of time from the High Court to the Resident Magistrate's Court was unlawful as only appeals may be transferred under S.45(2) of the Magistrates' Courts Act; thus, the proceedings and ruling by the Principal Resident Magistrate with Extended Jurisdiction were a nullity and are hereby nullified. The second application in the High Court was also improperly entertained and should have been struck out, not dismissed. The present application is misconceived and is struck out.
