- 03
Effect of non-refunded redemption money on the right to bequeath
Party arguments
- Applicant
- The respondent had no right to dispose of clan land by will; she only had a usufructuary right, and the land should remain with relatives after her death. The appellant also redeemed the pledged land and was not refunded.
- Respondent
- The bequest was valid as both the respondent and the beneficiary (Gabriel) belonged to the same clan, relying on sections 20 and 31 of the second schedule to Government Notice No. 436 of 1963.
05
Court’s reasoning
Legal principles
- 01
customary law; Government Notice No. 436 of 1963, sections 20 and 31
Clan land cannot be disposed of by will except in accordance with customary law; usufructuary rights do not confer power to bequeath without satisfying redemption obligations.
06
Ratio, limits and disposition
Ratio decidendi
The respondent could not validly bequeath her portion of clan land by will, as the ultimate title remained with the brother Kashumba Katundu, and the usufructuary right could not be devised before redemption money was refunded to the appellant.
Obiter and limits
- Even if the bequest was to a clan member, the act would be objectionable if redemption money was not refunded.
Court disposition
appeal allowed
- Judgment of the district court set aside
- Judgment of the primary court restored
- Appellant at liberty to proceed against personal representatives of the respondent to recover costs
