Ratio Decidendi

The Defendant admitted liability for the loss of fuel and agreed to pay the Plaintiff Uganda shillings 36,368,000/=. The court found that the Plaintiff is entitled to compensation for the admitted loss, but no evidence was adduced to support claims for negligence or loss of earnings, so those claims failed. The Plaintiff is entitled to interest at 20% per annum from the date of filing the suit (May 2014) to the date of the partial consent judgment (16 October 2015), and 14% per annum from the date of consent judgment until payment in full. Costs are awarded to the Plaintiff as the Defendant did not settle immediately and the Plaintiff incurred costs pursuing the claim.
