Ratio Decidendi

The trial judge erred by imposing a sentence of 27 years' imprisonment contrary to the plea bargain agreement, without formally rejecting the agreement as required by law. The Plea Bargain Rules prohibit the substitution of a judge-imposed sentence for the agreed sentence unless the agreement is rejected for causing a miscarriage of justice. The judge's reasons for enhancing the sentence did not amount to such a finding. The only lawful course was to either accept the agreement or reject it and proceed to trial.
