The High Court found that the trial court failed to comply with the order for re-trial by not hearing evidence from the parties and by relying on an incorrect case reference provided in the order. The error originated from the High Court itself, which specified the wrong case number, thereby impeding the appellant's ability to produce the relevant record. The principle that no act of court should harm a litigant required the High Court to rectify its own mistake. Consequently, the ruling of the lower court was set aside, and a fresh re-trial was ordered based on the correct record (Adjumani Civil Suit No. 57 of 2005), with costs of the appeal to abide the results of the re-trial.
