The court found that the respondent failed to provide the claimant with a reason for termination and did not accord him a hearing prior to termination, in violation of Sections 66 and 68 of the Employment Act and the respondent's own Human Resources Policy Manual. The right to terminate cannot be exercised arbitrarily; procedural fairness and disclosure of reasons are mandatory. The respondent's reliance on contractual notice did not absolve it from statutory procedural obligations. As a result, the termination was both substantively and procedurally unlawful.
