Procedural Posture

Constitutional Petition / Judgment

  1. 1 Whether the Chief Registrar and Secretary Law Council are proper respondents in a constitutional petition.
  2. 2 Whether the Constitutional Court has jurisdiction over the subject matter of the petition under Article 137 of the Constitution.
  3. 3 Whether the alleged acts and omissions require constitutional interpretation or enforcement of rights under Article 50.

Ratio Decidendi

The Constitutional Court lacks jurisdiction over the petition because the complaints raised do not require interpretation of any constitutional provision but rather seek redress for alleged infringement of rights. The proper avenue for such claims is enforcement under Article 50 of the Constitution before a competent court, or judicial review/appeal under the Advocates Act. The offices of the Chief Registrar and Secretary Law Council lack corporate legal personality and cannot be sued; only the Attorney General is the proper respondent. The petition is therefore incompetent and must be struck out with costs to the Attorney General.

Court Disposition

Petition struck out with costs to the Attorney General.

Orders

  • Petition against the Chief Registrar and Secretary Law Council is struck out.
  • Attorney General remains sole respondent.
