Miscellaneous Application / Ruling

  1. 1 Whether the application for recognition and enforcement of the arbitral award and consent should be granted.
  2. 2 Whether the requirements under Section 35(2) of the Arbitration and Conciliation Act have been met.
  3. 3 Whether the time for setting aside the arbitral award has expired under Section 34(3) of the Arbitration and Conciliation Act.

Ratio Decidendi

The court found that the applicant had produced a duly authenticated original arbitral award and that the arbitration agreement, though not attached to the application, was certified and referenced in the mother file. The requirements under Section 35(2)(a) and (b) of the Arbitration and Conciliation Act were therefore satisfied. The thirty-day period for challenging the award under Section 34(3) had expired without any application to set aside the award. Consequently, under Section 36, the arbitral award must be enforced as a decree of the court. The court recognized the arbitral award and issued a decree for its enforcement, awarding costs to the applicant.
