The Court found that although the respondents filed a Notice of Appeal on the same day the decision was delivered, they failed to seek leave to appeal within the 14 days prescribed by Rule 40(2)(a) of the Court of Appeal Rules. The subsequent application for leave was filed 35 days after the decision, well outside the statutory period. The Court rejected the respondents' argument that no time frame was specified in the Civil Procedure Rules, holding that the lacuna is filled by the Court of Appeal Rules.
