OKELLO }{\b\ul\insrsid5254533\charrsid3283016 \par RU}{\b\ul\insrsid1211481\charrsid3283016 LING: }{\b\ul\insrsid5254533\charrsid3283016 \par }{\insrsid1211481\charrsid3283016 The original case was by originating summons }{\insrsid12537729\charrsid3283016 whereby the plaintiff, a widow, }{\insrsid1211481\charrsid3283016 brought to be answered by this court some questions relating to the administration of the E}{\insrsid12537729\charrsid3283016 state of her deceased husband. \par }{\insrsid1211481\charrsid3283016 When the originating summons came up for hearing before me on 19/2/92, counsel for the defendant took a preliminary objection in which he contended th}{\insrsid12537729\charrsid3283016 at the originating summons was }{ \insrsid1211481\charrsid3283016 incompetent and improperly before this court o}{\insrsid12537729\charrsid3283016 n the ground that by it was accompanied by a defective affidavit. That the affidavit }{\insrsid1211481\charrsid3283016 does not disclose the source of information of those facts which are deponed to on information; that it does not give}{\insrsid12537729\charrsid3283016 }{\insrsid1211481\charrsid3283016 grounds of belief for thos}{\insrsid12537729\charrsid3283016 e facts which are deponed to on}{\insrsid1211481\charrsid3283016 belief; that the affidavit also does not distinguish between those facts which are deponed to on information, belief and on the deponent\rquote s knowledge; Further that the affidavit is tainted with inconsistency. On these }{\insrsid12537729\charrsid3283016 grounds}{\insrsid1211481\charrsid3283016 , the learned counsel prayed that the originating summons be dismi}{ \insrsid12537729\charrsid3283016 ssed with costs. \par }{\insrsid1211481\charrsid3283016 The relevant supporting affidavit was sworn by the plainti}{\insrsid12537729\charrsid3283016 ff Allen Isingoma (Mrs.) of P. O}{\insrsid1211481\charrsid3283016 . Box 139 }{\insrsid12537729\charrsid3283016 B}{ \insrsid1211481\charrsid3283016 ushenyi on}{\insrsid12537729\charrsid3283016 }{\insrsid1211481\charrsid3283016 5/12/91 as widow }{\insrsid12537729\charrsid3283016 o}{\insrsid1211481\charrsid3283016 f the deceased. The affidavit reads in part as follows: \emdash \par \'936 That on 13/2/92 I was led by. A1ex Muhairwe to the High Court \line Civil Registry and told by a clerk}{\insrsid12537729\charrsid3283016 to sign a form which I heard at}{\insrsid1211481\charrsid3283016 \line the meeting was to enable u}{ \insrsid12537729\charrsid3283016 s to withdraw money from the Co-}{\insrsid1211481\charrsid3283016 operative \line Bank Kase}{\insrsid12537729\charrsid3283016 se Branch.\'94 \par }{\insrsid1211481\charrsid3283016 8 - That since 13/2/91,}{\i\insrsid1211481\charrsid3283016 }{\insrsid1211481\charrsid3283016 I never heard from Muhairwe or any}{\insrsid12537729\charrsid3283016 ether executors regarding the Kases}{ \insrsid1211481\charrsid3283016 e money nor did I receive my children who were too y}{\insrsid12537729\charrsid3283016 oung to look after themselves. \par }{\insrsid1211481\charrsid3283016 9 - That on 3/4/91, I contacted my advocate to try and obtain for \line me not only the release of my children and als}{\insrsid4084913\charrsid3283016 o funds for their maintenance }{\insrsid1211481\charrsid3283016 and mine. (copy }{\insrsid4084913\charrsid3283016 of the letter written to counsel for the Estate}{\insrsid1211481\charrsid3283016 is }{\insrsid4084913\charrsid3283016 annexed hereto an marked \'93A\'94). \par }{\insrsid10626314 18. - That on 16-7-}{\insrsid1211481\charrsid3283016 92,}{\insrsid4084913\charrsid3283016 I was accompanied by Mr. Mweba}{\insrsid1211481\charrsid3283016 sa of Mwene Kahima Advocates a}{\insrsid4084913\charrsid3283016 nd an armed escort from the Dist}{\insrsid1211481\charrsid3283016 ri}{\insrsid4084913\charrsid3283016 ct Administrator went to Karoza with t}{\insrsid1211481\charrsid3283016 he permiss}{\insrsid10626314 ion of the Chairman RC III}{ \insrsid4084913\charrsid3283016 Mitoome }{\insrsid1211481\charrsid3283016 to }{\insrsid4084913\charrsid3283016 try and rescue the children who I }{\insrsid1211481\charrsid3283016 had b}{\insrsid4084913\charrsid3283016 een told by one Kanono working }{ \insrsid1211481\charrsid3283016 at Ishaka Hospital, were very sick and without any treatment (a }{\insrsid10626314 copy of the letter of chairman RC III}{\insrsid1211481\charrsid3283016 Mitoome is }{\insrsid10626314 arrested here and marked \lquote }{ \insrsid4084913\charrsid3283016 I\rquote .) \par }{\insrsid1211481\charrsid3283016 21 - That when I}{\insrsid4084913\charrsid3283016 }{\insrsid1211481\charrsid3283016 saw the state in which my childre}{\insrsid4084913\charrsid3283016 n were, I broke down in tears. \par }{\insrsid1211481\charrsid3283016 25 - That Mid Biribwa e}{\insrsid4084913\charrsid3283016 ats the lorry proceeds and Abaho coll}{\insrsid1211481\charrsid3283016 ects all the revenue from the milk and cattle at Karoza to the exclus}{ \insrsid4084913\charrsid3283016 ion by me and my children. \par 26-}{\insrsid1211481\charrsid3283016 That whatever is stated herein is true and correct to the best of my knowledge and belief\'94 }{\insrsid4084913\charrsid3283016 \par Expounding}{\insrsid1211481\charrsid3283016 his ar}{\insrsid4084913\charrsid3283016 g}{\insrsid1211481\charrsid3283016 ume}{\insrsid4084913\charrsid3283016 nt }{\insrsid1211481\charrsid3283016 Mr}{\insrsid4084913\charrsid3283016 .}{ \insrsid1211481\charrsid3283016 Muhwe}{\insrsid4084913\charrsid3283016 zi for the defendant contended }{\insrsid1211481\charrsid3283016 that th}{\insrsid4084913\charrsid3283016 e law requires that source of informatio}{\insrsid1211481\charrsid3283016 n of facts deponed to on information must be disclosed.}{\insrsid4084913\charrsid3283016 That failure to make such disclosure}{\insrsid1211481\charrsid3283016 renders}{\insrsid4084913\charrsid3283016 the affidavit incurably defecti}{ \insrsid1211481\charrsid3283016 ve. H}{\insrsid4084913\charrsid3283016 e r}{\insrsid1211481\charrsid3283016 elied on }{\b\ul\insrsid4084913\charrsid3283016 Kabwinukya }{\b\ul\insrsid1211481\charrsid3283016 vs. Kasigwa (1978) HCB 252 }{ \insrsid4084913\charrsid3283016 where it was held that failure to disclose}{\b\i\insrsid4084913\charrsid3283016 }{\insrsid4084913\charrsid3283016 the s}{\insrsid1211481\charrsid3283016 ource of }{\insrsid4084913\charrsid3283016 information}{ \insrsid1211481\charrsid3283016 renders }{\insrsid4084913\charrsid3283016 the affidavit defective. \par }{\insrsid9184109\charrsid3283016 Counsel pointed out that in }{\insrsid1211481\charrsid3283016 th}{\insrsid9184109\charrsid3283016 e instant}{\b\insrsid9184109\charrsid3283016 c}{\insrsid1211481\charrsid3283016 a}{\insrsid9184109\charrsid3283016 se, paragr}{\insrsid1211481\charrsid3283016 aph 6 }{\insrsid9184109\charrsid3283016 of the plaintiff\rquote s suppo}{\insrsid1211481\charrsid3283016 rtin}{\insrsid9184109\charrsid3283016 g}{\insrsid1211481\charrsid3283016 af}{ \insrsid9184109\charrsid3283016 fidavit seems to be deponed to on information but that the source of that information was not disclosed. He submitted}{\insrsid1211481\charrsid3283016 that this failure to disclose }{\insrsid9184109\charrsid3283016 the source of information rendered the affidavit incurably defective. \par }{\insrsid1211481\charrsid3283016 He further contended that it is also a requirement of the law that in an affidavit where facts are deponed to on belief of the deponent, the ground}{\insrsid9184109\charrsid3283016 of that belief must be given. T}{ \insrsid1211481\charrsid3283016 hat}{\insrsid9184109\charrsid3283016 failure to give such groun}{\insrsid1211481\charrsid3283016 d}{\insrsid9184109\charrsid3283016 renders the affidavit incurably defective. For this proposities}{ \insrsid1211481\charrsid3283016 counsel relied on }{\insrsid9184109\charrsid3283016 O}{\insrsid1211481\charrsid3283016 .7 r.3}{\i\insrsid1211481\charrsid3283016 }{\insrsid9184109\charrsid3283016 CPR. \par }{\insrsid1211481\charrsid3283016 Applying the}{\insrsid9184109\charrsid3283016 above principle to the instant case, the learned counsel}{\insrsid1211481\charrsid3283016 pointed out that paragraphs 6 and 25}{\i\insrsid1211481\charrsid3283016 }{ \insrsid1211481\charrsid3283016 of the plaintiff\rquote s supp orting affidavit contain facts which are deponed to on belief but that the grounds of these beliefs were not given. He submitted that the failure to give the ground for such belief rendered the }{\insrsid9184109\charrsid3283016 affidavit incurably defective. \par Th}{\insrsid1211481\charrsid3283016 irdly, Counsel contended that it is yet a requirement of the law }{\insrsid9184109\charrsid3283016 that an affidavit must disting}{\insrsid1211481\charrsid3283016 uish between facts}{\insrsid9184109\charrsid3283016 which are deponed to on belief}{\insrsid1211481\charrsid3283016 , }{\insrsid9184109\charrsid3283016 information or on knowledge. }{\insrsid1211481\charrsid3283016 \par That failure to make such distinction renders the affidavit \line incurably defective. For authority counsel cited }{\b\ul\insrsid9184109\charrsid3283016 Kabwinukya .v}{\b\ul\insrsid1211481\charrsid3283016 . Kasigwa}{\ul\insrsid1211481\charrsid3283016 above }{\insrsid9184109\charrsid3283016 \par Relating the above leg}{\insrsid1211481\charrsid3283016 al principle to the present case, the learned counsel pointed}{\insrsid9184109\charrsid3283016 out that in the instant case, }{\insrsid1211481\charrsid3283016 paragraph 26}{ \insrsid9184109\charrsid3283016 o}{\insrsid1211481\charrsid3283016 f the supporting affidavit does not distinguish between matters which are deponed to on belie}{\insrsid9184109\charrsid3283016 f and those deponed to of the}{ \insrsid1211481\charrsid3283016 deponent\rquote s knowledge. He submitted that this failure to make the distinction renders the }{\insrsid9184109\charrsid3283016 affidavit incurably defective. \par On his fourth gro}{\insrsid1211481\charrsid3283016 und, counsel contended that it is t}{\insrsid9184109\charrsid3283016 he law that inconsistency in an}{\insrsid1211481\charrsid3283016 affidavit however m inor must not be ignored since a sworn affidavit is a document not to}{\b\insrsid1211481\charrsid3283016 }{\insrsid1211481\charrsid3283016 be treated lightly. That if it contains an obvious falsehoo}{\insrsid6708935\charrsid3283016 d, then the entire affidavit bec}{\insrsid1211481\charrsid3283016 omes suspect. That an appl}{\insrsid6708935\charrsid3283016 ication which is supported by a false affidavit is bound to fail}{\insrsid1211481\charrsid3283016 . He cited }{ \b\ul\insrsid6708935\charrsid3283016 Bitainana vs. Kanan}{\b\ul\insrsid1211481\charrsid3283016 ura (1977) HCB 34}{\i\ul\insrsid1211481\charrsid3283016 }{\insrsid1211481\charrsid3283016 Applying the above principle to the present case, Mr. Muhwezi pointed out that }{\insrsid6708935\charrsid3283016 paragraph}{\insrsid1211481\charrsid3283016 8 and 23 of the supporting affidavit are }{\insrsid6708935\charrsid3283016 inconsistent}{ \insrsid1211481\charrsid3283016 on the question whether the plaintiff has since 13/2/91}{\i\insrsid1211481\charrsid3283016 }{\insrsid6708935\charrsid3283016 n}{\insrsid1211481\charrsid3283016 ot received h er children. Counsel submitted that the above is obvious contradiction}{\insrsid5075102\charrsid3283016 }{\insrsid1211481\charrsid3283016 and that }{\insrsid5075102\charrsid3283016 i}{\insrsid1211481\charrsid3283016 t renders the affidavit incurably defective because the applicant did}{\insrsid5075102\charrsid3283016 not come to court with a clean }{\insrsid1211481\charrsid3283016 hand}{\insrsid5075102\charrsid3283016 to tell the truth. \par }{\insrsid1211481\charrsid3283016 The learned counsel further contended that it is the law and practice of this court to refuse to act on defective affidavit. For authority he cited }{\ul\insrsid1211481\charrsid3283016 Kabwinukya v. Kasigwa above,}{ \insrsid5075102\charrsid3283016 }{\insrsid1211481\charrsid3283016 and submitted that each of the numerous defects pointed out above in the supportin}{\insrsid5075102\charrsid3283016 g affidavit in this case renders }{\insrsid1211481\charrsid3283016 the affida}{\insrsid5075102\charrsid3283016 vit incurably defective. He thus}{\insrsid1211481\charrsid3283016 invited me to}{\insrsid5075102\charrsid3283016 refuse to act on the affidavit}{\insrsid1211481\charrsid3283016 }{ \insrsid5075102\charrsid3283016 that}{\insrsid1211481\charrsid3283016 this leaves the originating summons without any supporting affidavit. That this rendered the originating summons incompetent and improperly before court f}{ \insrsid5075102\charrsid3283016 o}{\insrsid1211481\charrsid3283016 r failure to comp}{\insrsid5075102\charrsid3283016 ly with O.}{\insrsid1211481\charrsid3283016 34 r 7 CPR. He therefore prayed that th}{\insrsid5075102\charrsid3283016 e}{ \insrsid1211481\charrsid3283016 applic}{\insrsid5075102\charrsid3283016 ation be dismissed with costs. \par }{\insrsid1211481\charrsid3283016 On his part Mr. Mwebesa learn}{\insrsid5075102\charrsid3283016 ed counsel for the plaintiff contended that the preliminary obj}{\insrsid1211481\charrsid3283016 ection was misconceived and that it should }{ \insrsid5075102\charrsid3283016 b}{\insrsid1211481\charrsid3283016 e }{\insrsid5075102\charrsid3283016 overruled. \par }{\insrsid1211481\charrsid3283016 He argued that paragraph 6 of the supporting affidavit complies with the requirement of the law to disclose the source of information when it stated that it w}{\insrsid3161235\charrsid3283016 as the clerk who told her to sig}{\insrsid1211481\charrsid3283016 n the document and that the me}{\insrsid3161235\charrsid3283016 eting was the source of the othe}{\insrsid1211481\charrsid3283016 r information that the (form}{ \insrsid3161235\charrsid3283016 ) was to}{\insrsid1211481\charrsid3283016 enab}{\insrsid3161235\charrsid3283016 le them to withdraw money from Co}{\insrsid1211481\charrsid3283016 operative Bank Kasese Branch. He submitted that it was not necessary to disclose the name of the rel}{\insrsid3161235\charrsid3283016 evant clerk or who at the meeting}{\insrsid1211481\charrsid3283016 }{\insrsid3161235\charrsid3283016 g}{ \insrsid1211481\charrsid3283016 a}{\insrsid3161235\charrsid3283016 ve the information. \par }{\insrsid1211481\charrsid3283016 In reply, Mr. Muhwezi insisted however that it was essential to disclose the }{\insrsid3161235\charrsid3283016 name of such clerk or of the person at the meeting who gave}{\insrsid1211481\charrsid3283016 the information for the purp}{\insrsid3161235\charrsid3283016 ose of establishing the truth. \par }{\insrsid1211481\charrsid3283016 Mr. Mw}{\insrsid3161235\charrsid3283016 ebesa denied that the supporting affid}{\insrsid546593\charrsid3283016 avit ever conta}{\insrsid1211481\charrsid3283016 in facts deponed to on}{\insrsid546593\charrsid3283016 information.
