Ratio Decidendi

The trial Judge erred by failing to expressly state that the period the appellant spent on remand was taken into account when imposing sentence, as required by Article 23(8) of the Constitution and established case law. This omission rendered the sentence illegal and a nullity. The Court of Appeal, therefore, set aside the sentence and, considering the gravity of the offence, the appellant's plea of guilty, youth, and remand period of almost 1 year and 7 months, imposed a new sentence of 18 years imprisonment as appropriate and commensurate with the circumstances.
