He was confirmed in the post on 02.12.1981. \par \tab \hich\af0\dbch\af16\loch\f0 In 1984 plaintiff was transferred to the Ministry of L\hich\af0\dbch\af16\loch\f0 and}{\dbch\af16\insrsid12542207\charrsid5603017 \hich\af0\dbch\af16\loch\f0 s}{\dbch\af16\insrsid7737149\charrsid5603017 \hich\af0\dbch\af16\loch\f0 , Minerals and Water Resources and posted to Gulu land office. \par \tab \hich\af0\dbch\af16\loch\f0 While serving at Gulu Land office in 1991 the plaintiff\hich\f0 \rquote \loch\f0 s name was omitted and deleted from the payroll. No reason or explanation was given to the plaintiff for the omission and deletion, \hich\af0\dbch\af16\loch\f0 inspite of the plaintiff demanding for the same. \par }{\dbch\af16\insrsid15953527\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 On 14.11.2001 plaintiff instituted this suit. \par \hich\af0\dbch\af16\loch\f0 The issues framed for resolution by this court are:- \par {\listtext\pard\plain\dbch\af16\insrsid15953527\charrsid5603017 \hich\af0\dbch\af16\loch\f0 1.\tab}}\pard \ql \fi-375\li735\ri0\sl360\slmult1\widctlpar\jclisttab\tx735\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin735\itap0\pararsid15953527 { \dbch\af16\insrsid15953527\charrsid5603017 \hich\af0\dbch\af16\loch\f0 Whether the plaintiff was an employee of the Central Government. \par {\listtext\pard\plain\dbch\af16\insrsid9845022\charrsid5603017 \hich\af0\dbch\af16\loch\f0 2.\tab}}{\dbch\af16\insrsid9845022\charrsid5603017 \hich\af0\dbch\af16\loch\f0 Whether}{\dbch\af16\insrsid15953527\charrsid5603017 \hich\af0\dbch\af16\loch\f0 the plaintiff\hich\f0 \rquote \loch\f0 s employment}{\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 with t\hich\af0\dbch\af16\loch\f0 he Central Government was terminated lawfully.}{\dbch\af16\insrsid15953527\charrsid5603017
\par }\pard \ql \li360\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin360\itap0\pararsid7961684 {\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 3. The remedies available. \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid7961684 {\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 As to the first issue, according to Exhibit P1, the plaintiff was appointed on probation as a Clerical Officer in the Public Service by the Public Service Commission on 28.11.1977. \par \tab \hich\af0\dbch\af16\loch\f0 Some of the terms of his appointment were salary scale U8, a}{\dbch\af16\insrsid12542207\charrsid5603017 \hich\af0\dbch\af16\loch\f0 p}{\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 robation period of two years from date of appointment, and an undertaking, when the occasion demands, in the interest of the service, to serve in any part of Uganda by normal posting instruction\hich\af0\dbch\af16\loch\f0 s. \par \tab \hich\af0\dbch\af16\loch\f0 He was subsequently confirmed in service and on 25.09.1984, following transfer from police to Ministry of Lands, Minerals and Water Resources, posted to Gulu Land office:}{\dbch\af16\insrsid11613339\charrsid5603017 \hich\af0\dbch\af16\loch\f0 }{\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 the transfer le}{\dbch\af16\insrsid11613339\charrsid5603017 \hich\af0\dbch\af16\loch\f0 t}{\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 ter was exhibited as Exh}{\dbch\af16\insrsid11613339\charrsid5603017 \hich\af0\dbch\af16\loch\f0 i}{\dbch\af16\insrsid7961684\charrsid5603017 \hich\af0\dbch\af16\loch\f0 bit P3. \par }{\dbch\af16\insrsid138537\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 It is while he was at Gulu}{\dbch\af16\insrsid16071869\charrsid5603017 \hich\af0\dbch\af16\loch\f0 Lan\hich\af0\dbch\af16\loch\f0 d Office in February 1991 that his name was, without any valid reason, omitted and deleted from the payroll as a Public Servant. \par \hich\af0\dbch\af16\loch\f0 O}{\dbch\af16\insrsid12542207\charrsid5603017 \hich\af0\dbch\af16\loch\f0 n}{\dbch\af16\insrsid16071869\charrsid5603017 \hich\af0\dbch\af16\loch\f0 13.05.1999, T}{\dbch\af16\insrsid12542207\charrsid5603017 \hich\af0\dbch\af16\loch\f0 he }{\dbch\af16\insrsid16071869\charrsid5603017 \hich\af0\dbch\af16\loch\f0 Ministry of Water, Lands and Environment, communicated to the Chief Administrative Officer, Gulu District, a\hich\af0\dbch\af16\loch\f0 s per exhibit P5, regarding the plaintiff\hich\f0 \rquote \loch\f0 s plight, to the effect that, according to the Local Government statute of 1993, all officers found working at the Districts, plaintiff inclusive}{ \dbch\af16\insrsid12542207\charrsid5603017 \hich\af0\dbch\af16\loch\f0 ,}{\dbch\af16\insrsid16071869\charrsid5603017 \hich\af0\dbch\af16\loch\f0 were automatically taken over by Loca}{\dbch\af16\insrsid12542207\charrsid5603017 \hich\af0\dbch\af16\loch\f0 l Government when the said sta\hich\af0\dbch\af16\loch\f0 tute began to be operative.}{\dbch\af16\insrsid138537\charrsid5603017 \par }{\dbch\af16\insrsid4598495\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 The position thus adopted by the Ministry of Water, Lands and Environment was that the plaintiff and his plight were no longer the responsibility of the Ministry, that is Central }{\dbch\af16\insrsid4287820\charrsid5603017 \hich\af0\dbch\af16\loch\f0 Government}{\dbch\af16\insrsid4598495\charrsid5603017 \hich\af0\dbch\af16\loch\f0 , }{\dbch\af16\insrsid4287820\charrsid5603017 \hich\af0\dbch\af16\loch\f0 b}{\dbch\af16\insrsid4598495\charrsid5603017 \hich\af0\dbch\af16\loch\f0 ut rather that of Gulu District Loc\hich\af0\dbch\af16\loch\f0 al Government}{\dbch\af16\insrsid7735140\charrsid5603017 \hich\af0\dbch\af16\loch\f0 . }{\dbch\af16\insrsid4598495\charrsid5603017 \hich\af0\dbch\af16\loch\f0 Reliance for this pos}{ \dbch\af16\insrsid4287820\charrsid5603017 \hich\af0\dbch\af16\loch\f0 i}{\dbch\af16\insrsid4598495\charrsid5603017 \hich\af0\dbch\af16\loch\f0 tion was based on the Local Government (Resistance Councils) }{\dbch\af16\insrsid4287820\charrsid5603017 \hich\af0\dbch\af16\loch\f0 S}{\dbch\af16\insrsid4598495\charrsid5603017 \hich\af0\dbch\af16\loch\f0 tatute 1993. \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid7737149 {\dbch\af16\insrsid4933703\charrsid5603017 \hich\af0\dbch\af16\loch\f0 }{\dbch\af16\insrsid4287820\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 Court has come to the conclusion that the position taken by the Ministry of Water, Lands and Environment as regards who employed the }{\dbch\af16\insrsid8729021\charrsid5603017 \hich\af0\dbch\af16\loch\f0 plaintif \hich\af0\dbch\af16\loch\f0 f when}{\dbch\af16\insrsid7735140\charrsid5603017 \hich\af0\dbch\af16\loch\f0 the Local Government (Resistance Councils) statute became operative }{\dbch\af16\insrsid4287820\charrsid5603017 \hich\af0\dbch\af16\loch\f0 was wrong in law.}{\dbch\af16\insrsid4933703\charrsid5603017 \par }{\dbch\af16\insrsid11211511\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 Under the Local Governments (Resistance Councils) Statute, section 29(1) the staff of the District had to be appointed or allowed to act in any office of the Loca \hich\af0\dbch\af16\loch\f0 l Government by the District service Commission. \par \tab \hich\af0\dbch\af16\loch\f0 Such staff included the District Executive Secretary, a deputy and assistant District executive secretaries: section 31, Chiefs: section 32 and other staff as may be necessary for the proper performance of \hich\af0\dbch\af16\loch\f0 the functions of the council: section 34(1). Section 51(2) of the statute deemed one who had been in employment of the council immediately before the commencement of the statute to have been appointed and to hold office under the statute. \par \tab \hich\af0\dbch\af16\loch\f0 Regulation 20 of\hich\af0\dbch\af16\loch\f0 the Local Governments (Resistance Councils) Statute was similar to section 29(1) of the statute. \par \tab \hich\af0\dbch\af16\loch\f0 In the particular case of the plaintiff, there is no evidence availed to court that the }{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 plaintiff}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 was ever appointed or }{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 integrated}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 into the staf}{ \dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 f}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 of Gulu Dis\hich\af0\dbch\af16\loch\f0 trict by the District\hich\f0 \rquote \loch\f0 s servi}{ \dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 c}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 e Commission. The defendant do}{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 e}{ \dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 s not even plead so in his written statement of def}{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 e}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 nce d}{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 a}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 ted 18}{\super\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 th}{\dbch\af16\insrsid11211511\charrsid5603017 \hich\af0\dbch\af16\loch\f0 March 2002. \par }{\dbch\af16\insrsid2362267\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 In the administration of the Public Service}{\dbch\af16\insrsid1919412\charrsid5603017 \hich\af0\dbch\af16\loch\f0 ,}{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 transfers between the public service of the Government, to which the\hich\af0\dbch\af16\loch\f0 plaintiff belonged, and the public service of a district administration may only be made after the approval of the appropriate authority after consultation with the Minister responsible for Local Government and the Minster responsible for Public Service: \hich\af0\dbch\af16\loch\f0 \hich\af0\dbch\af16\loch\f0 See}{\dbch\af16\insrsid1721890\charrsid5603017 \hich\af0\dbch\af16\loch\f0 section 12(4) of the Public Service Act. There is no evidence of compliance with this section in }{ \dbch\af16\insrsid11868037\charrsid5603017 \hich\af0\dbch\af16\loch\f0 t}{\dbch\af16\insrsid1721890\charrsid5603017 \hich\af0\dbch\af16\loch\f0 he case of the plaintiff. \par \tab \hich\af0\dbch\af16\loch\f0 Court answers the first issue to the effect that the plaintiff was at all material time an employee of the Central Government.\hich\af0\dbch\af16\loch\f0 \par \tab \hich\af0\dbch\af16\loch\f0 The second issue is whether the plaintiff\hich\f0 \rquote \loch\f0 s employment with the Central Government was terminated lawfully.}{\dbch\af16\insrsid2362267\charrsid5603017 \hich\af0\dbch\af16\loch\f0 \par }{\dbch\af16\insrsid11868037\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 The evidence adduced establishes that the plaintiff\hich\f0 \rquote \loch\f0 s employment in the Public Service was not terminated by any communication to him by his em \hich\af0\dbch\af16\loch\f0 ployer either by way of notice to terminate or through the process of any disciplinary action and procedure. The defendant just omitted and deleted the plaintiff\hich\f0 \rquote \loch\f0 s name from the payroll and stopped paying salary and other emolument in February 1991. \par \tab \hich\af0\dbch\af16\loch\f0 The \hich\af0\dbch\af16\loch\f0 reason for treating the plaintiff so by the defendant was, according to the defendant, because the plaintiff\hich\f0 \rquote \loch\f0 s employment had now been taken over by Gulu District Administration. \par \tab \hich\af0\dbch\af16\loch\f0 Court has already held the defendant\hich\f0 \rquote \loch\f0 s above reason for so treating the plai\hich\af0\dbch\af16\loch\f0 ntiff to have been wrong and that plaintiff all along remained an employee of the defendant.
\par }{\dbch\af16\insrsid6955572\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 A dismissal from employment is wrongful if the same is made without justifiable cause and without reasonable notice: }{\b\i\ul\dbch\af16\insrsid6955572\charrsid5603017 \hich\af0\dbch\af16\loch\f0 See A. M. JABI VS MBALE MUNICIPAL COUNCIL (197\hich\af0\dbch\af16\loch\f0 3) HCB 191. \par }{\dbch\af16\insrsid6955572\charrsid5603017 \tab \hich\af0\dbch\af16\loch\f0 The defendant was, by law, obligated to provide work to the plaintiff and since the plaintiff carried out his part of the contract, then salary and other emoluments were, by law, deemed due from the defendant to the plaintiff at the expiration \hich\af0\dbch\af16\loch\f0 of every month worked: See sections 17 and 36 of the Employment Act. An employer has an obligation to pay the employee the remuneration for }{\dbch\af16\insrsid1919412\charrsid5603017 \hich\af0\dbch\af16\loch\f0 h}{ \dbch\af16\insrsid6955572\charrsid5603017 \hich\af0\dbch\af16\loch\f0 is/her services as agreed under the contract.
