In Article 13 of the contract, the client undertook to make payment to the plaintiff within 15 days following receipt of the supplier\hich\f0 \rquote \loch\f0 s invoice \hich\af0\dbch\af12\loch\f0 . In Article 20}{\dbch\af12\insrsid11735861\charrsid12000394 \hich\af0\dbch\af12\loch\f0 of the contract,}{\dbch\af12\insrsid13069539\charrsid12000394 \hich\af0\dbch\af12\loch\f0 in case of a dispute, the parties agreed to refer the dispute to an adjudicator/arbitrator, and in case they }{\dbch\af12\insrsid1335828\charrsid12000394 \hich\af0\dbch\af12\loch\f0 could not}{\dbch\af12\insrsid13069539\charrsid12000394 \hich\af0\dbch\af12\loch\f0 agree on one, then the dispute }{\dbch\af12\insrsid1335828\charrsid12000394 \hich\af0\dbch\af12\loch\f0 was to be referred }{\dbch\af12\insrsid13069539\charrsid12000394 \hich\af0\dbch\af12\loch\f0 to a competent court for due determination.}{\dbch\af12\insrsid16266482\charrsid12000394 \par }{\dbch\af12\insrsid8398125\charrsid12000394 \par \hich\af0\dbch\af12\loch\f0 Nowhere \hich\af0\dbch\af12\loch\f0 in the contract is i}{\dbch\af12\insrsid1335828\charrsid12000394 \hich\af0\dbch\af12\loch\f0 t }{\dbch\af12\insrsid8398125\charrsid12000394 \hich\af0\dbch\af12\loch\f0 provided that the defendant was not to be liable for paying the plaintiff and that payment was to be by the donor. \par \par \hich\af0\dbch\af12\loch\f0 The reference in the contract to refer the dispute to an arbitrator under Article 20 of the contract agreement, exhibi\hich\af0\dbch\af12\loch\f0 t P2, does not o}{\dbch\af12\insrsid1335828\charrsid12000394 \hich\af0\dbch\af12\loch\f0 ust }{\dbch\af12\insrsid8398125\charrsid12000394 \hich\af0\dbch\af12\loch\f0 the jurisdiction of this court from entertaining the suit. The jurisdiction of this court is conferred by Article 139}{ \dbch\af12\insrsid1335828\charrsid12000394 \hich\af0\dbch\af12\loch\f0 (}{\dbch\af12\insrsid8398125\charrsid12000394 \hich\af0\dbch\af12\loch\f0 1) of the }{\dbch\af12\insrsid1335828\charrsid12000394 \hich\af0\dbch\af12\loch\f0 C}{ \dbch\af12\insrsid8398125\charrsid12000394 \hich\af0\dbch\af12\loch\f0 onstitution. The evidence}{\dbch\af12\insrsid12745811\charrsid12000394 \hich\af0\dbch\af12\loch\f0 of both witnesses was detailed as to how the seedlings and seeds were supplied at the agreed upon stations to}{\dbch\af12\insrsid10684546\charrsid12000394 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid12745811\charrsid12000394 \hich\af0\dbch\af12\loch\f0 and with the approval of the defendant\hich\f0 \rquote \loch\f0 s designated officers}{\dbch\af12\insrsid10684546\charrsid12000394 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid12745811\charrsid12000394 \hich\af0\dbch\af12\loch\f0 and how plaintiff carried out what\hich\af0\dbch\af12\loch\f0 was required}{\dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 of him to do under the contract by way of li}{ \dbch\af12\insrsid10684546\charrsid12000394 \hich\af0\dbch\af12\loch\f0 n}{\dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 ing and pitting. The evidence of PW1 and PW2 was not in any way rebutted by the defendant. The defendant also never disputed, and adduced no evidence, to dispute the amount of money, claimed for\hich\af0\dbch\af12\loch\f0 the work done.}{ \dbch\af12\insrsid12087064\charrsid12000394 \par }{\dbch\af12\insrsid9009162\charrsid12000394 \par \hich\af0\dbch\af12\loch\f0 Defendant has not established any }{\dbch\af12\insrsid10684546\charrsid12000394 \hich\af0\dbch\af12\loch\f0 other }{\dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 valid reason}{ \dbch\af12\insrsid10684546\charrsid12000394 \hich\af0\dbch\af12\loch\f0 , other than the invalid one that money was being got from a donor,}{\dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 as to why payment of the sum claimed was not effected to the plaintiff when the work under the contract had been comple\hich\af0\dbch\af12\loch\f0 ted. In the absence of such}{\dbch\af12\insrsid10684546\charrsid12000394 \hich\af0\dbch\af12\loch\f0 valid}{\dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 reason for non payment, the defendant committed breach of the contract, Exhibit P2. \par \par \hich\af0\dbch\af12\loch\f0 The third issue is whether the parties are entitled to the reliefs prayed for. \par \par \hich\af0\dbch\af12\loch\f0 Plaintiff is entitled to the money for the supply of the\hich\af0\dbch\af12\loch\f0 seedlings and seeds; as supported by the report of the Acting Environment/}{\dbch\af12\insrsid159458\charrsid12000394 \hich\af0\dbch\af12\loch\f0 Wetlands}{\dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 officer, Pader, Ochen Morris, Exhibit P4. }{\dbch\af12\insrsid14483976\charrsid12000394 \hich\af0\dbch\af12\loch\f0 The}{ \dbch\af12\insrsid9009162\charrsid12000394 \hich\af0\dbch\af12\loch\f0 money due under this item is Ug. Shs 10.210,124/=}{\dbch\af12\insrsid159458\charrsid12000394 \hich\af0\dbch\af12\loch\f0 . This sum is awarded to the plaintiff.}{ \dbch\af12\insrsid9009162\charrsid12000394 \par }{\dbch\af12\insrsid159458\charrsid12000394 \par \hich\af0\dbch\af12\loch\f0 Plaintiff also claimed general dam\hich\af0\dbch\af12\loch\f0 ages for breach of contract.
