The trial judge failed to comply with the mandatory requirement under Article 23(8) of the Constitution to deduct the period spent on remand from the sentence imposed. The judge did not identify or arithmetically deduct the exact period the appellant spent in pre-trial custody, rendering the sentence illegal. The appellate court, therefore, invoked its powers under Section 11 of the Judicature Act to re-sentence the appellant, taking into account both mitigating and aggravating factors, sentencing guidelines, and consistency with similar cases.
