The court held that the right to a fair hearing extends to all stages of proceedings, including execution, and that any material placed before the court in violation of this right must be set aside. Furthermore, the Taxing Officer erred in awarding costs for the valuation report, as the original decree did not provide for such costs. The award of costs was therefore set aside.
