The Tribunal found that Arua District Local Government failed to implement the Government Policy Decision on the Development and Management of Markets by not informing stall owners of their rights and not facilitating the formation of associations or cooperatives. The Authority erred in finding that Arua DLG was justified in ignoring the policy simply because there were no organized vendors. The Tribunal held that the bidding document used by Arua DLG was a wholesale deviation from the standard document and required express consent from the Authority, which was not obtained.
