The counterclaim, being an independent suit, required proper adjudication. Furthermore, the magistrate failed to address the pecuniary jurisdiction as required by Section 207(1)(b) of the Magistrate (Amendment) Act 2007, given that the value of the suit property likely exceeded the statutory limit for Grade 1 Magistrates.
