Procedural Posture

Criminal Revision / Application for Revision of Magistrate's Ruling

  1. 1 Whether non-compliance with section 159 of the Traffic and Road Safety Act (Cap. 361) renders the prosecution of the applicant a nullity.
  2. 2 Whether the procedural requirements in section 159 are mandatory or directory.

Ratio Decidendi

The court held that the procedural requirements in section 159 of the Traffic and Road Safety Act (Cap. 361) are not mandatory but directory. Their purpose is to highlight the ideal standard, not to create a bar to prosecution. Section 161 of the same Act and section 42(1) of the Magistrates Courts Act provide alternative lawful means for instituting proceedings. There is no conflict between these provisions, and non-compliance with section 159 does not render the prosecution a nullity. The applicant did not demonstrate any prejudice resulting from the alleged non-compliance. Therefore, the application to nullify the magistrate's ruling was dismissed, and the trial was ordered to proceed.
