The application is not barred by res judicata because previous decisions, including those of the Supreme Court and Court of Appeal, were made on preliminary points of law and technicalities, not on the merits of the alleged fraud. The substantive issue of fraud in the procurement of the consent judgment has never been fully adjudicated. However, the applicants have failed to prove fraud to the required standard, as their evidence is limited to affidavit statements and an untested police report. Serious allegations of fraud require proper pleadings and tested evidence, not mere affidavit evidence. The appropriate course is to allow the applicants to file a fresh suit with proper pleadings...
