Procedural Posture

Miscellaneous Cause / Ruling on Application for Representative Suit

  1. 1 Whether the applicants should be granted leave to sue in a representative capacity on behalf of 44 other former employees.
  2. 2 Whether all intended claimants have provided proper written authorization as required by law.

Ratio Decidendi

The court found that while most intended claimants provided written authorization and identification, eight out of the forty-six did not provide the required written authorization, and several others did not attach identification as agreed. Compliance with Order 1 Rule 8(2)(b) is mandatory for a representative suit. The absence of written authorization from some claimants means they cannot be represented without further notice and compliance. The court directed the applicants to give notice to the non-compliant claimants about the intended suit and reliefs sought, so they may provide written authorization in accordance with the rules. No order as to costs was made.

Court Disposition

  • No order as to costs is made.
