The lower court erred in condemning the appellant to pay costs for the second respondent, as mistakes of counsel should not be visited on the litigant absent misconduct by the litigant. Furthermore, an advocate should not be ordered to pay costs personally without being given an opportunity to be heard. The decision to penalise the appellant for his counsel's blunder was unjustified, and the order for costs against the appellant is set aside. Costs of the appeal are awarded to the appellant.
