The court found that the tenancy agreement dated 8th October 2017 (Exb. P.1) was questionable due to serious distortions in its English translation and inconsistencies regarding the referenced agreements. The evidence suggested that the agreement relied upon by the Plaintiff did not meet the requirements of a valid contract under Section 10 of the Contracts Act 2010. Consequently, the Plaintiff's claim failed as there was no valid contract to enforce, rendering all subsequent issues moot. The Defendant's counterclaim was dismissed for want of prosecution as he failed to fix it for hearing within the prescribed period.
