Miscellaneous Application / Ruling on Application for Extension of Time to Appeal

  1. 1 Whether the application reveals sufficient grounds to support the prayers sought.
  2. 2 What remedies are available to the parties.

Ratio Decidendi

The applicant failed to demonstrate sufficient cause for the extension of time to appeal. Ignorance of the law and procedural errors do not constitute good cause under Section 79 of the Civil Procedure Act. The delay of nearly five years was excessive and not justified by the circumstances. The interests of justice, equity, and public policy do not support granting the extension in this case. The application is therefore dismissed, and the applicant is ordered to pay costs.
