The court found that the 1st and 2nd respondents did not possess valid letters of administration at the time of filing Civil Suit No. 142 of 2022, as these had been revoked in a prior suit. Without valid letters, the respondents lacked locus standi to commence any action on behalf of the estate of the late Albert Mackay Kalula Mukasa. The absence of locus standi meant that the plaint did not disclose a cause of action against the applicant. The court applied Order 7 rule 11(a) of the Civil Procedure Rules and relevant case law, concluding that the suit was incompetent and an abuse of court process. Accordingly, the plaint and suit were struck out and costs awarded to the applicant.
