The Plaintiff’s title to plot 8 was registered prior to the 1st Defendant’s and is therefore valid and takes priority under the Registration of Titles Act. The 1st Defendant’s subsequent title was obtained fraudulently with the collusion of the 2nd Defendant, who disregarded the Plaintiff’s subsisting lease and application for extension. The Plaintiff fulfilled all requirements for extension of lease on plots 6 and 7, and the 2nd Defendant’s grant of a lease to the 1st Defendant over these plots was fraudulent and unlawful.
