The court determined that the power of attorney purportedly authorizing the mortgage of Kibuga Block 20, Plot 254 was not produced in evidence, and the only power of attorney on record related to a different property. The absence of the relevant power of attorney was fatal to the respondent's claim, as primary evidence is required to prove such authority.
