The marriage between the parties is valid, having been celebrated at a licensed place of worship (Nyanama Church of Nazarene) and officiated by a recognized minister. Desertion was proved by evidence that the respondent left the matrimonial home in 2020 and has not returned, satisfying the statutory requirement for dissolution. Cruelty was not proved as the evidence was contradictory and insufficient. There was no proof of matrimonial property.
