The plaintiff established, through documentary evidence and witness testimony, that the defendant obtained a loan of shs. 71,000,000/=, with a pre-existing loan offset as per contract terms. The defendant defaulted on repayment, and failed to provide evidence of payment or discharge of the debt. The evidential burden shifted to the defendant, who did not meet it. The plaintiff was contractually entitled to offset the top-up loan against the existing loan, and the deduction was lawful. The defendant's counterclaim was unsupported by evidence. The plaintiff is entitled to recover the outstanding balance, interest, and costs.
