The Plaintiffs entered into a valid sale agreement with the 1st Defendant for 0.80 acres of land, paid a substantial portion of the purchase price, and took possession, thereby acquiring an equitable interest. The Defendants breached the agreement by failing to subdivide and transfer the title as covenanted, and subsequently sold the entire plot to the 3rd Defendant, resulting in the Plaintiffs' eviction. The Plaintiffs are no longer interested in recovering the land but are entitled to compensation at the prevailing market value, less the unpaid balance, to prevent unjust enrichment.
