She}{\insrsid2112869\charrsid8803012 sought also relief f}{ \insrsid14705663\charrsid8803012 o}{\insrsid2112869\charrsid8803012 r general damages and }{\insrsid14705663\charrsid8803012 costs. \par }{\insrsid2112869\charrsid8803012 The facts of}{\insrsid14705663\charrsid8803012 this case were briefly that One Ezira Bino}{\insrsid2112869\charrsid8803012 n}{\insrsid14705663\charrsid8803012 d}{\insrsid2112869\charrsid8803012 o N}{ \insrsid8662746\charrsid8803012 yakaan}{\insrsid2112869\charrsid8803012 a hereinafter referred to as }{\insrsid8662746\charrsid8803012 the testator made a Will dated 10}{\super\insrsid8662746\charrsid8803012 th}{\insrsid8803012 day }{ \insrsid8662746\charrsid8803012 of May }{\insrsid2112869\charrsid8803012 1985}{\insrsid8662746\charrsid8803012 }{\insrsid2112869\charrsid8803012 in}{\insrsid8662746\charrsid8803012 }{\insrsid2112869\charrsid8803012 which he appointed the plaintiff his daughter and others to be }{\insrsid8662746\charrsid8803012 the executrix and executors of the said will respectively}{\insrsid2112869\charrsid8803012 . Three years later the testator died and that was on 30th Dece}{ \insrsid8662746\charrsid8803012 mber, 198 and was buried on 2}{\super\insrsid8662746\charrsid8803012 nd}{\insrsid8662746\charrsid8803012 }{\insrsid2112869\charrsid8803012 February, 1989. He was a reputable businessman in }{ \insrsid8662746\charrsid8803012 and}{\insrsid2112869\charrsid8803012 around Fort Portal Municipality. His children numbered between 24 }{\insrsid8662746\charrsid8803012 and 26. \par At the tim}{\insrsid2112869\charrsid8803012 e of his }{\insrsid8662746\charrsid8803012 burial at his residence at Kaih}{\insrsid2112869\charrsid8803012 ura, the Will was not available to be read to the children and the relatives of the said }{ \insrsid8662746\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 . It was brought and read to the children on appointment by one Kagaba of Kagaba and }{\i\insrsid2112869\charrsid8803012 Co. }{\insrsid2112869\charrsid8803012 Advocates Fort Portal and that was on the 26th February, 1989 almost two months after the demise of the testator. After the ill had been read it generated a lot of opposition and protests by a cross section of the public and children generally on the pretext that the testator could not have made such a Will and that }{\insrsid8662746\charrsid8803012 the}{\insrsid2112869\charrsid8803012 time lag from the date the testator was buried to the time when the Will as }{\insrsid8662746\charrsid8803012 finally}{\insrsid2112869\charrsid8803012 read was not convincingly explained to the children or for this matter the beneficiaries. }{ \insrsid8662746\charrsid8803012 That the Will was forged and changed in order with the wishes of the plaintiff and others. \par The will was also }{\insrsid2112869\charrsid8803012 o}{\insrsid8662746\charrsid8803012 p}{\insrsid2112869\charrsid8803012 p}{\insrsid8662746\charrsid8803012 os}{\insrsid2112869\charrsid8803012 ed}{\i\insrsid2112869\charrsid8803012 }{ \insrsid2112869\charrsid8803012 because it appointed two elderly wome}{\insrsid1779589\charrsid8803012 n wives of the testator; it also}{\insrsid2112869\charrsid8803012 }{\insrsid1779589\charrsid8803012 appointed}{\insrsid2112869\charrsid8803012 a minor and a man of unsound mind both being grandson}{\insrsid1779589\charrsid8803012 }{\insrsid2112869\charrsid8803012 and son of the }{\insrsid1779589\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 respectively. An }{ \insrsid1533321\charrsid8803012 effort was ma}{\insrsid2112869\charrsid8803012 de by the}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 clan leader and others to reconcile the }{\insrsid1779589\charrsid8803012 children}{ \insrsid2112869\charrsid8803012 but they failed to compromise and hence of }{\insrsid1779589\charrsid8803012 course}{\insrsid8803012 this }{\insrsid1779589\charrsid8803012 action for}{\insrsid1533321\charrsid8803012 grant of probate. \par The issue}{\insrsid2112869\charrsid8803012 s were }{\insrsid1533321\charrsid8803012 whether}{\insrsid2112869\charrsid8803012 the will was }{\insrsid1533321\charrsid8803012 valid.}{\insrsid2112869\charrsid8803012 }{\insrsid1533321\charrsid8803012 Secondly}{\insrsid2112869\charrsid8803012 whether the applicants for }{\insrsid1533321\charrsid8803012 grant }{\insrsid2112869\charrsid8803012 were fit and }{\insrsid1533321\charrsid8803012 proper persons for}{\insrsid2112869\charrsid8803012 the grant } {\insrsid1533321\charrsid8803012 of probate. \par }{\insrsid2112869\charrsid8803012 On }{\insrsid3500011\charrsid8803012 the}{\insrsid2112869\charrsid8803012 first issue }{\insrsid3500011\charrsid8803012 whether}{\insrsid2112869\charrsid8803012 the Will was }{\insrsid3500011\charrsid8803012 valid, PW}{ \insrsid2112869\charrsid8803012 .1 an advocate from K}{\insrsid3500011\charrsid8803012 a}{\insrsid2112869\charrsid8803012 gaba & C}{\insrsid3500011\charrsid8803012 o. Advocates testified that on express}{\insrsid2112869\charrsid8803012 instructi ons from the testator drafted}{\insrsid3500011\charrsid8803012 }{\insrsid2112869\charrsid8803012 a Will and }{\insrsid3500011\charrsid8803012 produced three copies, Exhibit P1 & P}{\insrsid2112869\charrsid8803012 2 and a third copy. He received}{ \i\insrsid2112869\charrsid8803012 }{\insrsid3500011\charrsid8803012 back exhibits P1 & P2 from the }{\insrsid2112869\charrsid8803012 testator which he kept for custody. }{\insrsid3500011\charrsid8803012 H}{\insrsid2112869\charrsid8803012 e signed and endorsed the date on the two exhibits. The third copy remained with the testator and the same was never brought to him for either his signature or in order to endorse the date on the same. He produced }{\insrsid3500011\charrsid8803012 exhibited}{\insrsid2112869\charrsid8803012 P}{\insrsid3500011\charrsid8803012 1}{\insrsid2112869\charrsid8803012 and P2 and read the same to the public and }{\insrsid3500011\charrsid8803012 children}{\insrsid2112869\charrsid8803012 after}{ \i\insrsid2112869\charrsid8803012 }{\insrsid3500011\charrsid8803012 having been contacted by PW.2. \par }{\insrsid2112869\charrsid8803012 P. W.2 a friend of the testator and of whose clan he was the clan leader happened to peruse the copy of the Will given to him by the testator. The said copy was consistent wi}{\insrsid8803012 th the wishes of the t estator. }{\insrsid2112869\charrsid8803012 P. W.3}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 and P. W.4 were called upon by the testator to go and attest the Will. They were given the Will which they perused and after which the }{ \insrsid3500011\charrsid8803012 testators}{\insrsid2112869\charrsid8803012 first signed and they also signed the same. They were 3 wit}{\insrsid3500011\charrsid8803012 nesses who witnesse}{\insrsid8803012 d the signing of the said Will }{ \insrsid3500011\charrsid8803012 i.e. PW}{\insrsid2112869\charrsid8803012 .3, }{\insrsid3500011\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 .4 }{\insrsid3500011\charrsid8803012 and one Kalemera who }{\insrsid2112869\charrsid8803012 never testif}{ \insrsid3500011\charrsid8803012 ied here because was dead but P}{\insrsid2112869\charrsid8803012 W.3 and}{\insrsid3500011\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 .4 }{\insrsid3500011\charrsid8803012 were consistent that they saw K}{ \insrsid2112869\charrsid8803012 alemera sign }{\insrsid3500011\charrsid8803012 the copies of the will exhibit Pl, P2 and the third copy. \par P}{\insrsid2112869\charrsid8803012 W.5 (the plaintiff) testified that she had no say in drafting copies of the said Wills Ex. P1, }{\insrsid3500011\charrsid8803012 P2 but only learnt that she was appointed}{\insrsid2112869\charrsid8803012 an }{ \insrsid3500011\charrsid8803012 executrix}{\insrsid2112869\charrsid8803012 together}{\insrsid3500011\charrsid8803012 with four others after the Will had been}{\insrsid2112869\charrsid8803012 read on 26th February, 1989 }{ \insrsid3500011\charrsid8803012 by PW.1. \par DW1}{\insrsid2112869\charrsid8803012 , }{\insrsid3500011\charrsid8803012 D}{\insrsid2112869\charrsid8803012 W2 and DW3 son and }{\insrsid3500011\charrsid8803012 daughters}{\insrsid2112869\charrsid8803012 of the testator respectively were positive }{ \insrsid3500011\charrsid8803012 that}{\insrsid2112869\charrsid8803012 their father the testato}{\insrsid3500011\charrsid8803012 r could not have made such a Will}{\insrsid2112869\charrsid8803012 }{\insrsid3500011\charrsid8803012 o}{ \insrsid2112869\charrsid8803012 n }{\insrsid3500011\charrsid8803012 the}{\insrsid2112869\charrsid8803012 day the tes}{\insrsid10238507\charrsid8803012 tator vas buried PW}{\insrsid2112869\charrsid8803012 .2 informed D}{\insrsid10238507\charrsid8803012 W} {\insrsid2112869\charrsid8803012 1 that the }{\insrsid10238507\charrsid8803012 testator\rquote s w}{\insrsid2112869\charrsid8803012 ill was in Kampala and that the same}{\insrsid10238507\charrsid8803012 would be read by Tom Rubale. W}{ \insrsid2112869\charrsid8803012 hereas DW3 used to hold conversation with the testator and they used to talk about ills }{\insrsid10238507\charrsid8803012 and the testator informed her DW}{\insrsid2112869\charrsid8803012 3 as he had made a Will in 1988. DW1, DW2 & }{\insrsid10238507\charrsid8803012 DW}{\insrsid2112869\charrsid8803012 3 }{\insrsid10238507\charrsid8803012 were not happy when the Will}{\insrsid2112869\charrsid8803012 took too long to be read to the children and the fact }{\insrsid10238507\charrsid8803012 that DW1}{\insrsid2112869\charrsid8803012 being the eldest son }{\insrsid10238507\charrsid8803012 w}{\insrsid2112869\charrsid8803012 as not mentio ned in the Will and he should have been made }{\insrsid10238507\charrsid8803012 the}{\insrsid2112869\charrsid8803012 heir. DW1 concluded a Will by Tom Rubale should have been produced a}{\insrsid10238507\charrsid8803012 nd rend to the children. Also DW}{ \insrsid2112869\charrsid8803012 3 claimed that there must have been a Will of 1988. That the Will read to them was net the Will made by the }{\insrsid10238507\charrsid8803012 testator. \par Mr. Mug}{\insrsid2112869\charrsid8803012 amba appearing for the plaintiff submitted that the plaintiff has produced witnesses to prove the Will. The learned counsel th}{\insrsid10238507\charrsid8803012 en ran through the evidence of P}{ \insrsid2112869\charrsid8803012 . W.1 to P. W.5. He continu}{\insrsid10238507\charrsid8803012 ed that the defendant and Mrs. M}{\insrsid2112869\charrsid8803012 ubiru DW2 simply said th}{\insrsid10238507\charrsid8803012 at the testator could not have m}{ \insrsid2112869\charrsid8803012 ade such a hill because George Nyakaana the defendant and eldest son of the }{\insrsid10238507\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 was left out and that he should have been mentioned more prominently in the Will. Mr. Mugamba further submitted that a Will is a private wish by an individual and no matter what publicity dictates what he chooses to leave as his last wish }{\insrsid10238507\charrsid8803012 constitutes}{ \insrsid2112869\charrsid8803012 his word barring extrinsi}{\insrsid10238507\charrsid8803012 c }{\insrsid2112869\charrsid8803012 evidence factors lik e insanity and extra. He submitted further that Nyakaana was alive and well when he made the Will and the court should find that his wishes ought to be allowed to }{\insrsid10238507\charrsid8803012 be implemented and that include}{ \insrsid2112869\charrsid8803012 d the persons he cared to appoint as executors of his Will. }{\insrsid10238507\charrsid8803012 He}{\insrsid2112869\charrsid8803012 reiterated that the law of }{\insrsid10238507\charrsid8803012 Succession}{ \insrsid2112869\charrsid8803012 is clear executors are }{\insrsid10238507\charrsid8803012 appointed}{\insrsid2112869\charrsid8803012 in the Will unless they are dead or unavailable at the tine of the death of the deceased or the Will }{ \insrsid10238507\charrsid8803012 materializes or at the time the will is found. They will not also be available as executors if they opt not to act as such. The court saw }{\insrsid2112869\charrsid8803012 the executors }{\insrsid10238507\charrsid8803012 and executrixes in court. They w}{\insrsid2112869\charrsid8803012 ere alive and allegations }{\insrsid10238507\charrsid8803012 of}{\insrsid2112869\charrsid8803012 senility }{\insrsid10238507\charrsid8803012 and being young were baseless. \par }{\insrsid2112869\charrsid8803012 The learned counsel representing the }{\insrsid10238507\charrsid8803012 defendant}{\insrsid2112869\charrsid8803012 on the }{\insrsid10238507\charrsid8803012 other}{\insrsid2112869\charrsid8803012 hand submitted that the Will }{\insrsid10238507\charrsid8803012 was}{\insrsid2112869\charrsid8803012 a forgery and t}{\insrsid595787\charrsid8803012 hat was and clear when PW.1 the author of the W}{\insrsid2112869\charrsid8803012 ill gave his evidence. The statement of Kag}{\insrsid595787\charrsid8803012 a}{\insrsid2112869\charrsid8803012 ba was an }{\insrsid595787\charrsid8803012 embarrassment}{\insrsid2112869\charrsid8803012 to the }{\insrsid595787\charrsid8803012 profession and an }{\insrsid2112869\charrsid8803012 abuse }{\insrsid595787\charrsid8803012 of the professional ethics}{\insrsid2112869\charrsid8803012 }{\insrsid595787\charrsid8803012 that}{\insrsid2112869\charrsid8803012 no prudent }{ \insrsid595787\charrsid8803012 advocate}{\insrsid2112869\charrsid8803012 could have purported to draw a document of that nature. I}{\insrsid595787\charrsid8803012 n cross examination PW.}{\insrsid2112869\charrsid8803012 1 could not }{ \insrsid595787\charrsid8803012 differentiate}{\insrsid2112869\charrsid8803012 }{\insrsid595787\charrsid8803012 the}{\insrsid2112869\charrsid8803012 papers used in typing the Will. And he could not even differentiate between the typewriter appearing on the original }{\insrsid595787\charrsid8803012 W}{\insrsid2112869\charrsid8803012 ill and the different typewriter appearing on the }{ \insrsid595787\charrsid8803012 duplicate}{\insrsid2112869\charrsid8803012 (copy) and }{\insrsid595787\charrsid8803012 that}{\insrsid2112869\charrsid8803012 he could not }{\insrsid595787\charrsid8803012 even}{\insrsid2112869\charrsid8803012 explain between the time lag when the deceased passed away and the time when the kill was read to the }{\insrsid595787\charrsid8803012 public.}{\insrsid2112869\charrsid8803012 He even witnessed }{\insrsid595787\charrsid8803012 the}{ \insrsid2112869\charrsid8803012 }{\insrsid595787\charrsid8803012 W}{\insrsid2112869\charrsid8803012 ill after the testator had signed. }{\insrsid595787\charrsid8803012 He}{\insrsid2112869\charrsid8803012 should have signed in the presence of the testator when the latter was }{\ul\insrsid2112869\charrsid8803012 signing the same. }{\insrsid2112869\charrsid8803012 P. W.1 could not even explain th}{\insrsid8803012 e different colours }{ \insrsid2112869\charrsid8803012 used in the document. The ill on t}{\insrsid595787\charrsid8803012 he part of it appeared forged. }{\insrsid2112869\charrsid8803012 There were}{\insrsid595787\charrsid8803012 two}{\i\insrsid2112869\charrsid8803012 }{ \insrsid2112869\charrsid8803012 conflicting dates one}{\insrsid8803012 is dated 10th September, 1985 }{\insrsid595787\charrsid8803012 and another one dated 10}{\super\insrsid595787\charrsid8803012 th}{\insrsid595787\charrsid8803012 M}{ \insrsid2112869\charrsid8803012 ay, 1985}{\i\insrsid2112869\charrsid8803012 . }{\i\insrsid595787\charrsid8803012 \par }{\insrsid2112869\charrsid8803012 Under Section 50 of the Succession Act Cap 139 for Wills of this nature unprivileged Wills the }{\insrsid595787\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 must execute his Will accord}{ \insrsid595787\charrsid8803012 ing to the following provision:- \par }\pard \s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid595787 {\insrsid2112869\charrsid8803012 (a) The }{\insrsid595787\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 shall sign or shall fix his mark to the Will or it shall be }{\insrsid595787\charrsid8803012 signed}{\insrsid2112869\charrsid8803012 by some other }{\insrsid595787\charrsid8803012 person}{\insrsid2112869\charrsid8803012 in his p}{ \insrsid595787\charrsid8803012 resence and by his direction. \par }{\insrsid2112869\charrsid8803012 (b) The signature or mark of the testator or the s}{\insrsid595787\charrsid8803012 ignature or mark of the testator}{\insrsid2112869\charrsid8803012 or }{\insrsid595787\charrsid8803012 the}{ \insrsid2112869\charrsid8803012 signature of the person signing }{\insrsid595787\charrsid8803012 for}{\insrsid2112869\charrsid8803012 him shall appear that it }{\i\insrsid2112869\charrsid8803012 was }{\insrsid595787\charrsid8803012 intend}{ \insrsid2112869\charrsid8803012 ed thereby to give ef}{\insrsid595787\charrsid8803012 fect to the writing as a Will. \par }{\insrsid2112869\charrsid8803012 (c) The Will shall be attested by }{\insrsid595787\charrsid8803012 two}{\insrsid2112869\charrsid8803012 or more witnesses each of whom must have seen the testator sign or affix his mark to the Will or have seen some other person sign the Will in the presence and by the direction of the }{\insrsid595787\charrsid8803012 testator or have received from the testator a person acknowledgment of his signature or }{\insrsid2112869\charrsid8803012 mark}{\insrsid595787\charrsid8803012 or}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 of the sig}{ \insrsid595787\charrsid8803012 nature of such other person one}{\insrsid2112869\charrsid8803012 each of the }{\insrsid595787\charrsid8803012 witnesses}{\insrsid2112869\charrsid8803012 must sign }{\insrsid595787\charrsid8803012 the}{ \insrsid2112869\charrsid8803012 Will in the presence of }{\insrsid595787\charrsid8803012 the}{\insrsid2112869\charrsid8803012 }{\insrsid595787\charrsid8803012 testator}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 but it shall not}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 be }{\insrsid595787\charrsid8803012 necessary}{\insrsid2112869\charrsid8803012 that}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 more then one witnesses be present at the acme time, and no }{\insrsid595787\charrsid8803012 particular}{\insrsid2112869\charrsid8803012 form of attestation shall be necessary. }{\ul\insrsid2112869\charrsid8803012 Se}{\ul\insrsid595787\charrsid8803012 e also }{\ul\insrsid12679555\charrsid8803012 Halsbury\rquote s}{\ul\insrsid2112869\charrsid8803012 Laws }{\ul\insrsid595787\charrsid8803012 of}{\ul\insrsid2112869\charrsid8803012 England 3 }{\ul\insrsid595787\charrsid8803012 Edition}{ \ul\insrsid2112869\charrsid8803012 Vol}{\ul\insrsid12679555\charrsid8803012 .}{\ul\insrsid2112869\charrsid8803012 9 }{\ul\insrsid12679555\charrsid8803012 para}{\ul\insrsid2112869\charrsid8803012 1324 Page 875. }{\insrsid12679555\charrsid8803012 \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid7758711 {\insrsid12679555\charrsid8803012 In}{\insrsid2112869\charrsid8803012 }{\insrsid12679555\charrsid8803012 the}{ \i\insrsid2112869\charrsid8803012 }{\insrsid12679555\charrsid8803012 present}{\insrsid2112869\charrsid8803012 }{\insrsid12679555\charrsid8803012 case PW.1 drafted the W}{\insrsid2112869\charrsid8803012 ill and the same was presented to the }{ \insrsid12679555\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 . It was }{\insrsid12679555\charrsid8803012 of}{\insrsid2112869\charrsid8803012 }{\insrsid12679555\charrsid8803012 course}{\insrsid2112869\charrsid8803012 in writing and was signed by }{\insrsid12679555\charrsid8803012 the}{\insrsid2112869\charrsid8803012 testator whose signature was made and acknowledg}{\insrsid12679555\charrsid8803012 e in the presence of PW.3, PW}{\insrsid2112869\charrsid8803012 .4 and one Kalemera who also proceeded to sign the }{\insrsid12679555\charrsid8803012 same. DW1 and}{\insrsid2112869\charrsid8803012 D}{\insrsid12679555\charrsid8803012 W}{\insrsid2112869\charrsid8803012 3 testified that that }{ \insrsid12679555\charrsid8803012 could}{\insrsid2112869\charrsid8803012 }{\insrsid12679555\charrsid8803012 not possibl}{\insrsid2112869\charrsid8803012 y have }{\insrsid12679555\charrsid8803012 been }{\insrsid2112869\charrsid8803012 the last }{ \insrsid12679555\charrsid8803012 will le}{\insrsid2112869\charrsid8803012 ft by their father the }{\insrsid12679555\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 . }{\insrsid12679555\charrsid8803012 DW1}{\insrsid2112869\charrsid8803012 was confident that}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 the as }{\insrsid14301859\charrsid8803012 a W}{\insrsid2112869\charrsid8803012 ill drafted by }{\insrsid14301859\charrsid8803012 Tom Rubale and DW}{ \insrsid2112869\charrsid8803012 3 was also }{\insrsid14301859\charrsid8803012 certain that }{\insrsid2112869\charrsid8803012 the testator ought }{\insrsid14301859\charrsid8803012 to have made}{\insrsid2112869\charrsid8803012 an up}{ \insrsid14301859\charrsid8803012 to }{\insrsid2112869\charrsid8803012 date bill of 1988. The claim by DW1 and D}{\insrsid14301859\charrsid8803012 W}{\insrsid2112869\charrsid8803012 3}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 that there }{\insrsid14301859\charrsid8803012 were}{\insrsid2112869\charrsid8803012 }{\insrsid14301859\charrsid8803012 other Wills made by Tom Ruba}{\insrsid2112869\charrsid8803012 le or that the testator ought to have mad}{ \insrsid14301859\charrsid8803012 e one in 1988 all that was not }{\insrsid2112869\charrsid8803012 substantiated. The alleged hills were not produced in court and the only Will produced in court was the disputed will exhibits }{ \insrsid14301859\charrsid8803012 P1 and}{\insrsid2112869\charrsid8803012 P2. }{\insrsid14301859\charrsid8803012 I believed PW1, PW2, PW3, Pw}{\insrsid2112869\charrsid8803012 4 }{\insrsid14301859\charrsid8803012 and PW5. I}{ \insrsid2112869\charrsid8803012 am of the opinion that t}{\insrsid14301859\charrsid8803012 hey told this court the truth. \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14705663 {\insrsid14301859\charrsid8803012 W}{\insrsid2112869\charrsid8803012 ith regard to the submission by the learned counsel for the defendant that the ill was a }{\insrsid7758711\charrsid8803012 forgery because PW}{\insrsid8803012 1 could not }{\insrsid2112869\charrsid8803012 differentiate the papers used in Typing the Will and could not even differentiate the papers used between the Typewriter appearing on the original Will and the different typewriter appearing on the duplicate paper and the time lag the delay}{ \insrsid7758711\charrsid8803012 in reading the bill and that P}{\insrsid2112869\charrsid8803012 W.1 was an embarrassment to the profession. To start with I am of the view that the learned counsel w}{\insrsid7758711\charrsid8803012 as demanding too much from PW1}{\insrsid2112869\charrsid8803012 if he expected an advocate who has a staff to do the typing to know the make or the types of paper used in typing a document }{\insrsid7758711\charrsid8803012 as was in the instant }{ \insrsid2112869\charrsid8803012 case. He would be stooping too low }{\insrsid7758711\charrsid8803012 to}{\insrsid15872983\charrsid8803012 know all that. \par A}{\insrsid2112869\charrsid8803012 n }{\insrsid15872983\charrsid8803012 advocate employs}{\insrsid2112869\charrsid8803012 a st}{\insrsid15872983\charrsid8803012 a}{\insrsid2112869\charrsid8803012 ff and}{\i\insrsid2112869\charrsid8803012 }{ \insrsid2112869\charrsid8803012 perhaps who }{\insrsid15872983\charrsid8803012 carry cut the purchases of the stationeries. He is n}{\insrsid2112869\charrsid8803012 ot expected to }{\insrsid15872983\charrsid8803012 know}{\insrsid2112869\charrsid8803012 the inside cut of the }{\insrsid15872983\charrsid8803012 details}{\insrsid9045415\charrsid8803012 of oil the}{\insrsid15872983\charrsid8803012 stationeries}{\insrsid2112869\charrsid8803012 purchased (the papers) and what typewriter was used in ty}{ \insrsid15872983\charrsid8803012 ing such and such document. PW}{\insrsid2112869\charrsid8803012 1 explained }{\insrsid15872983\charrsid8803012 that he type}{\insrsid2112869\charrsid8803012 d 3 }{\insrsid15872983\charrsid8803012 documents/Will. The original W}{\insrsid4662480\charrsid8803012 ill Ex P1}{\insrsid2112869\charrsid8803012 a copy Ex. }{\insrsid4662480\charrsid8803012 P2 and}{\insrsid2112869\charrsid8803012 a third copy which was retained by the }{ \insrsid4662480\charrsid8803012 testator and which he never signed an}{\insrsid2112869\charrsid8803012 d never endorsed the dates. The learned counsel for}{\i\insrsid2112869\charrsid8803012 }{\insrsid4662480\charrsid8803012 the}{ \insrsid2112869\charrsid8803012 }{\insrsid4662480\charrsid8803012 defendant}{\insrsid2112869\charrsid8803012 submitted that the }{\insrsid4662480\charrsid8803012 Wills were forged. Ex}{\insrsid2112869\charrsid8803012 p }{\insrsid4662480\charrsid8803012 P1 and P}{\insrsid2112869\charrsid8803012 2 were dated 10/5/85 and that }{\insrsid4662480\charrsid8803012 da}{\insrsid2112869\charrsid8803012 te tallies with the testimony of }{\insrsid4662480\charrsid8803012 whereas}{\insrsid2112869\charrsid8803012 }{ \insrsid9045415\charrsid8803012 Ex. D1}{\insrsid2112869\charrsid8803012 was }{\insrsid9045415\charrsid8803012 dated 10}{\super\insrsid9045415\charrsid8803012 th}{\insrsid9045415\charrsid8803012 }{\insrsid2112869\charrsid8803012 September, 1985. I was }{ \insrsid9045415\charrsid8803012 opportuned}{\insrsid2112869\charrsid8803012 t}{\insrsid9045415\charrsid8803012 o loo}{\insrsid2112869\charrsid8803012 k at }{\insrsid9045415\charrsid8803012 exhibit D1}{\insrsid2112869\charrsid8803012 . It was a }{ \insrsid9045415\charrsid8803012 Photostat}{\insrsid2112869\charrsid8803012 copy of }{\insrsid9045415\charrsid8803012 E}{\insrsid2112869\charrsid8803012 xp}{\insrsid9045415\charrsid8803012 . P2}{\insrsid2112869\charrsid8803012 . It was dated }{ \insrsid9045415\charrsid8803012 10}{\super\insrsid9045415\charrsid8803012 th}{\insrsid9045415\charrsid8803012 Septem}{\insrsid2112869\charrsid8803012 ber 1985}{\i\insrsid2112869\charrsid8803012 }{\insrsid9045415\charrsid8803012 and was unsigned by PW}{ \insrsid2112869\charrsid8803012 1. The }{\insrsid9045415\charrsid8803012 latter denied to have endorsed the date on Ex. D1}{\insrsid2112869\charrsid8803012 but the document bore the }{\insrsid9045415\charrsid8803012 signatures}{ \insrsid2112869\charrsid8803012 of the testators and the three witnesses who w}{\insrsid9045415\charrsid8803012 itnessed the W}{\insrsid2112869\charrsid8803012 ill. It must be recalled that the third }{\insrsid9045415\charrsid8803012 copy of the W}{ \insrsid2112869\charrsid8803012 ill remained with the testator}{\insrsid9045415\charrsid8803012 .}{\insrsid2112869\charrsid8803012 }{\insrsid9045415\charrsid8803012 The}{\insrsid2112869\charrsid8803012 latter wrote names of people in ink on exhibit P1 and initi}{\insrsid9045415\charrsid8803012 aled. He did not write on Ex. D1}{\insrsid2112869\charrsid8803012 . I am }{\insrsid9045415\charrsid8803012 of}{\insrsid2112869\charrsid8803012 the opinion and this is my finding that }{\insrsid9045415\charrsid8803012 exhibit D1}{\insrsid2112869\charrsid8803012 was }{\insrsid14047269 p}{\insrsid9045415\charrsid8803012 hotostatted}{\insrsid2112869\charrsid8803012 from the third copy of the Will which }{\insrsid9045415\charrsid8803012 remained in the possession}{\insrsid2112869\charrsid8803012 of the t}{\insrsid9045415\charrsid8803012 estator and the writing on Ex. P}{\insrsid16143809\charrsid8803012 1}{ \insrsid2112869\charrsid8803012 paper cover was not a }{\insrsid9045415\charrsid8803012 forgery}{\insrsid2112869\charrsid8803012 . Those names were mentioned in the Will as guardians. The defence did not explain to the court hew}{ \insrsid9045415\charrsid8803012 they came to possess exhibit D1}{\insrsid16143809\charrsid8803012 . }{\insrsid2112869\charrsid8803012 Therefore if there was any forgery }{\insrsid16143809\charrsid8803012 of}{\insrsid2112869\charrsid8803012 the }{ \insrsid16143809\charrsid8803012 W}{\insrsid2112869\charrsid8803012 ill at all that was }{\insrsid16143809\charrsid8803012 committed by }{\insrsid2112869\charrsid8803012 the defence which }{\insrsid16143809\charrsid8803012 filled dates in the third copy } {\insrsid2112869\charrsid8803012 retained by the }{\insrsid16143809\charrsid8803012 testator. I}{\insrsid2112869\charrsid8803012 say so }{\insrsid16143809\charrsid8803012 because}{\insrsid2112869\charrsid8803012 the defence was affirming that the Will was forged the evidential burden therefore shifted on them to affirm their assertions. They apparently failed to discharge }{\insrsid16143809\charrsid8803012 that burden. \par PW1}{\insrsid2112869\charrsid8803012 was accused by the defence of being an embarrassment to the profession because of the }{\insrsid16143809\charrsid8803012 role he played in drafting the W}{\insrsid2112869\charrsid8803012 ill}{ \insrsid16143809\charrsid8803012 .}{\insrsid2112869\charrsid8803012 }{\insrsid16143809\charrsid8803012 The}{\insrsid2112869\charrsid8803012 defence contended }{\insrsid16143809\charrsid8803012 that he was guilty of professional}{ \insrsid10049413\charrsid8803012 misconduct. \par }{\insrsid2112869\charrsid8803012 S. 82 }{\insrsid14693638\charrsid8803012 of the Advocate}{\insrsid2112869\charrsid8803012 Act 1970 }{\insrsid14693638\charrsid8803012 (}{\insrsid2112869\charrsid8803012 Act 22 }{\insrsid14693638\charrsid8803012 of}{ \insrsid2112869\charrsid8803012 the 1970) defines professional misconduct as including disgraceful}{\insrsid14693638\charrsid8803012 or}{\i\insrsid2112869\charrsid8803012 }{\insrsid14693638\charrsid8803012 dishonorable}{\insrsid2112869\charrsid8803012 conduct }{\insrsid14693638\charrsid8803012 not be fitting}{\insrsid2112869\charrsid8803012 }{\insrsid14693638\charrsid8803012 a}{\insrsid2112869\charrsid8803012 n }{\insrsid14693638\charrsid8803012 advocate}{\insrsid2112869\charrsid8803012 . In fact any complaint }{\insrsid14693638\charrsid8803012 against}{\insrsid2112869\charrsid8803012 an }{\insrsid14693638\charrsid8803012 advocate}{\insrsid2112869\charrsid8803012 for }{\insrsid14693638\charrsid8803012 professional misconduct}{ \insrsid2112869\charrsid8803012 would be }{\insrsid14693638\charrsid8803012 enquired}{\insrsid2112869\charrsid8803012 }{\insrsid14693638\charrsid8803012 into}{\insrsid2112869\charrsid8803012 by the disciplinary }{\insrsid14693638\charrsid8803012 Committee}{\insrsid2112869\charrsid8803012 of }{\insrsid14693638\charrsid8803012 the Law }{\insrsid10049413\charrsid8803012 council}{\insrsid14693638\charrsid8803012 See section}{\insrsid2112869\charrsid8803012 19 }{\insrsid14693638\charrsid8803012 of} {\insrsid2112869\charrsid8803012 the }{\insrsid14693638\charrsid8803012 Advocates Act 1970. The}{\insrsid2112869\charrsid8803012 fact that 1. W.1 did not witness the }{\insrsid10049413\charrsid8803012 testator sign the Will plus PW}{ \insrsid2112869\charrsid8803012 3 and}{\insrsid10049413\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 4}{\i\insrsid2112869\charrsid8803012 }{\insrsid10049413\charrsid8803012 one Kalamera the om}{\insrsid2112869\charrsid8803012 ission }{ \insrsid10049413\charrsid8803012 to}{\insrsid2112869\charrsid8803012 do so did not amount}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 to professional misconduct. There w}{\insrsid10049413\charrsid8803012 as no requirement in law that PW.1 ought to have been}{\insrsid2112869\charrsid8803012 }{\insrsid10049413\charrsid8803012 present}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 when the said Will was being attested and }{ \insrsid10049413\charrsid8803012 signed}{\insrsid2112869\charrsid8803012 by the testa}{\insrsid10049413\charrsid8803012 tor. \par It was also suggested}{\insrsid2112869\charrsid8803012 }{\insrsid10049413\charrsid8803012 by the defence }{\insrsid2112869\charrsid8803012 that the time lag i.e. from the time }{\insrsid10049413\charrsid8803012 the deceased died up to the time}{ \insrsid2112869\charrsid8803012 of the reading of the Will, the latter}{\insrsid15552455\charrsid8803012 was being manipulated so as to}{\insrsid2112869\charrsid8803012 tally with the aspirations of the Plaintiff }{\insrsid15552455\charrsid8803012 (PW} {\insrsid2112869\charrsid8803012 .5). Th}{\insrsid15552455\charrsid8803012 e}{\insrsid2112869\charrsid8803012 latter denied knowledge }{\insrsid15552455\charrsid8803012 of}{\insrsid2112869\charrsid8803012 }{\insrsid15552455\charrsid8803012 the W}{ \insrsid2112869\charrsid8803012 ill till the moment the till was read to the children. I}{\insrsid15552455\charrsid8803012 be1ieve}{\insrsid2112869\charrsid8803012 d her, }{\insrsid15552455\charrsid8803012 she told this cou}{ \insrsid2112869\charrsid8803012 rt}{\insrsid15552455\charrsid8803012 the}{\insrsid2112869\charrsid8803012 truth. }{\insrsid15552455\charrsid8803012 P}{\insrsid2112869\charrsid8803012 W.2 also explained to the children the relatives why the Will could not be read simply because . W.1 the author }{\insrsid13642225\charrsid8803012 and custodian of the Will was no}{\insrsid2112869\charrsid8803012 t around on the date the testator was buried. }{\insrsid7231628\charrsid8803012 According}{\insrsid2112869\charrsid8803012 to T. W.2 a date was fixed for P. W.1 to go and }{\insrsid13642225\charrsid8803012 read the will}{\insrsid2112869\charrsid8803012 and that was done. The learned counsel representing the defendant submitted that the delay in the production of}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 the Will to be read to the children }{\insrsid13642225\charrsid8803012 was because PW}{\insrsid2112869\charrsid8803012 1 was forging the same to fit in the }{\insrsid13642225\charrsid8803012 aspirations}{\insrsid2112869\charrsid8803012 of}{\insrsid13642225\charrsid8803012 PW5}{\i\insrsid2112869\charrsid8803012 }{ \insrsid2112869\charrsid8803012 by appointing her }{\insrsid13642225\charrsid8803012 executrix}{\insrsid2112869\charrsid8803012 together with four incompetent executrixes end executors respectively. I do not agree with the learned }{ \insrsid13642225\charrsid8803012 counsel.}{\insrsid2112869\charrsid8803012 The omission to produce the Will on the bur}{\insrsid13642225\charrsid8803012 ial date was ably explained by P}{\insrsid2112869\charrsid8803012 . W.2 whom I believed told this court the truth. }{\insrsid13642225\charrsid8803012 Moreover}{\insrsid2112869\charrsid8803012 , no evidence was le}{\insrsid13642225\charrsid8803012 d by the defence to show that P}{\insrsid2112869\charrsid8803012 W.1 knew } {\insrsid13642225\charrsid8803012 of}{\insrsid2112869\charrsid8803012 th}{\insrsid13642225\charrsid8803012 e burial date of the testator or}{\insrsid2112869\charrsid8803012 for this matter}{\insrsid13642225\charrsid8803012 any knowledge about the death }{\insrsid2112869\charrsid8803012 of t}{\insrsid13642225\charrsid8803012 he}{\insrsid2112869\charrsid8803012 }{\insrsid13642225\charrsid8803012 testato}{\insrsid2112869\charrsid8803012 r}{\i\insrsid2112869\charrsid8803012 }{\insrsid13642225\charrsid8803012 and deliberately stayed away. M}{\insrsid727252\charrsid8803012 y finding is that the}{\insrsid2112869\charrsid8803012 }{\insrsid727252\charrsid8803012 W}{\insrsid2112869\charrsid8803012 ill as }{ \insrsid727252\charrsid8803012 never forg}{\insrsid2112869\charrsid8803012 ed at all. There was no manipulation of the }{\insrsid727252\charrsid8803012 W}{\insrsid2112869\charrsid8803012 ill during the time lag as }{\insrsid727252\charrsid8803012 the}{ \insrsid2112869\charrsid8803012 defence wanted this court to believe. It is true t}{\insrsid727252\charrsid8803012 h}{\insrsid2112869\charrsid8803012 at the}{\i\insrsid2112869\charrsid8803012 }{\insrsid727252\charrsid8803012 testator}{ \insrsid2112869\charrsid8803012 used red ink in signing exhibit P1 and }{\insrsid727252\charrsid8803012 a}{\insrsid2112869\charrsid8803012 t the same time used blue ink in signing exhibit P2. There }{\insrsid727252\charrsid8803012 was}{ \insrsid2112869\charrsid8803012 no suggestion }{\insrsid727252\charrsid8803012 that the testator\lquote s signature}{\insrsid2112869\charrsid8803012 on Ex}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 P1 }{ \insrsid727252\charrsid8803012 & P2 were no}{\insrsid2112869\charrsid8803012 t similar. }{\insrsid727252\charrsid8803012 When}{\insrsid2112869\charrsid8803012 }{\insrsid727252\charrsid8803012 questioned}{\insrsid2112869\charrsid8803012 about the different types of pens used by the }{\insrsid727252\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 in signing}{\i\insrsid2112869\charrsid8803012 }{\insrsid727252\charrsid8803012 P}{\insrsid2112869\charrsid8803012 1 and }{ \insrsid727252\charrsid8803012 E}{\insrsid2112869\charrsid8803012 x }{\insrsid727252\charrsid8803012 P}{\insrsid2112869\charrsid8803012 2. }{\insrsid727252\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 .3}{\i\insrsid2112869\charrsid8803012 & }{ \insrsid727252\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 .4 could}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 not recall the type of pens the }{\insrsid13001402\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 used}{\insrsid9465813\charrsid8803012 in signing the 2 exhibits. I do}{\insrsid2112869\charrsid8803012 not }{\insrsid9465813\charrsid8803012 think that PW.3 and PW}{\insrsid2112869\charrsid8803012 .4 were }{\insrsid9465813\charrsid8803012 deliberately} {\insrsid2112869\charrsid8803012 telling lies to the court but I am of the opinion they might have }{\insrsid9465813\charrsid8803012 forgotten}{\insrsid2112869\charrsid8803012 some details due to }{\insrsid15952438\charrsid8803012 lapse of time. \par It w}{\insrsid2112869\charrsid8803012 as almost five years ago }{\insrsid15952438\charrsid8803012 w}{\insrsid2112869\charrsid8803012 hen }{\insrsid15952438\charrsid8803012 PW}{\i\insrsid2112869\charrsid8803012 .}{\insrsid2112869\charrsid8803012 3}{ \i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 and P. W.4 attested the said }{\insrsid15952438\charrsid8803012 will. \par }{\insrsid2112869\charrsid8803012 About }{\insrsid15952438\charrsid8803012 the claim by DW}{\insrsid2112869\charrsid8803012 1 that he should have been mentioned in the }{\insrsid15952438\charrsid8803012 w}{\insrsid2112869\charrsid8803012 ill as heir and } {\insrsid15952438\charrsid8803012 that}{\insrsid2112869\charrsid8803012 he could have bee}{\insrsid15952438\charrsid8803012 n prominently mentioned in the W}{\insrsid2112869\charrsid8803012 ill as the oldest son of the testator as per his testimony and } {\insrsid15952438\charrsid8803012 those}{\insrsid6834596\charrsid8803012 of DW}{\insrsid2112869\charrsid8803012 2 and }{\insrsid6834596\charrsid8803012 DW}{\insrsid2112869\charrsid8803012 3}{\i\insrsid2112869\charrsid8803012 . }{ \insrsid2112869\charrsid8803012 First of all his claim could act}{\insrsid6834596\charrsid8803012 be supported by the evidence on}{\insrsid2112869\charrsid8803012 record. The testator was free to choose him }{\i\insrsid2112869\charrsid8803012 as }{ \insrsid2112869\charrsid8803012 his}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 heir or not. Because of being the eldest son is not necessarily his best son. And according to the evidence available since the }{ \insrsid6834596\charrsid8803012 testator and DW1}{\insrsid2112869\charrsid8803012 \lquote s mother had falle}{\insrsid6834596\charrsid8803012 n }{\insrsid2112869\charrsid8803012 out with each other and had separated long before his death that cl early showed that he very little affection fur DW1 }{\ul\insrsid6834596\charrsid8803012 See Asumani Kavula vs Y. Lim}{\ul\insrsid2112869\charrsid8803012 ina 1977 HCB P. 310. }{\insrsid6834596\charrsid8803012 Moreover according to DW}{ \insrsid2112869\charrsid8803012 1 he was well provided for during }{\insrsid6834596\charrsid8803012 the}{\insrsid2112869\charrsid8803012 life time of the testator. The }{\insrsid6834596\charrsid8803012 latter had given him a s}{ \insrsid2112869\charrsid8803012 hop where he was running his retail business and was renting some roams on the shop building to some people. Probably one would that th}{\insrsid6834596\charrsid8803012 e shop premises were gift to DW1 Intervivos. \par On the other hand I }{\insrsid2112869\charrsid8803012 am of the view that the testator had }{\insrsid6834596\charrsid8803012 definitely}{\insrsid2112869\charrsid8803012 much }{\insrsid6834596\charrsid8803012 affection}{\insrsid2112869\charrsid8803012 for According to the latter she was recalled from Nairobi by the }{\insrsid6834596\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 where }{\insrsid6834596\charrsid8803012 she}{\insrsid2112869\charrsid8803012 was employed and }{ \insrsid6834596\charrsid8803012 returned home to assist the testator in running the various businesses}{\insrsid2112869\charrsid8803012 . An}{\insrsid6834596\charrsid8803012 d}{\insrsid2112869\charrsid8803012 }{\insrsid6834596\charrsid8803012 even}{ \insrsid2112869\charrsid8803012 }{\insrsid6834596\charrsid8803012 a}{\insrsid2112869\charrsid8803012 fter her marriage}{\insrsid8332467\charrsid8803012 PW5}{\i\insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 continued}{ \insrsid2112869\charrsid8803012 running the many }{\insrsid8332467\charrsid8803012 businesses}{\insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 together}{\insrsid2112869\charrsid8803012 with the }{\insrsid8332467\charrsid8803012 testator a}{\insrsid2112869\charrsid8803012 n}{\insrsid8332467\charrsid8803012 d was awarded very m}{\insrsid2112869\charrsid8803012 any }{\insrsid8332467\charrsid8803012 g}{\insrsid2112869\charrsid8803012 ifts at}{\i\insrsid2112869\charrsid8803012 }{ \insrsid8332467\charrsid8803012 the}{\insrsid2112869\charrsid8803012 time of her marriage.}{\insrsid8332467\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 5}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 testified that }{ \insrsid8332467\charrsid8803012 she was give}{\insrsid2112869\charrsid8803012 n a car, }{\insrsid8332467\charrsid8803012 house}{\insrsid2112869\charrsid8803012 , }{\insrsid8332467\charrsid8803012 cow and}{\insrsid2112869\charrsid8803012 extra. An}{ \insrsid8332467\charrsid8803012 d}{\insrsid2112869\charrsid8803012 as}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 if that was not }{\insrsid8332467\charrsid8803012 enough}{\insrsid2112869\charrsid8803012 }{ \insrsid8332467\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 5}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 an}{\insrsid8332467\charrsid8803012 d}{\insrsid2112869\charrsid8803012 th}{\insrsid8332467\charrsid8803012 e}{ \insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 were the }{\insrsid8332467\charrsid8803012 only}{\insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 signatories}{ \insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 to}{\insrsid2112869\charrsid8803012 the Bank accounts. An}{\insrsid8332467\charrsid8803012 d}{\insrsid2112869\charrsid8803012 even she }{\insrsid8332467\charrsid8803012 held s hares in the Tobacco}{\insrsid2112869\charrsid8803012 Company. It was ap1arent }{\insrsid8332467\charrsid8803012 PW}{\i\insrsid2112869\charrsid8803012 5 }{\insrsid2112869\charrsid8803012 was very }{\insrsid8332467\charrsid8803012 close}{ \insrsid2112869\charrsid8803012 t}{\insrsid8332467\charrsid8803012 o}{\insrsid2112869\charrsid8803012 the }{\i\insrsid8332467\charrsid8803012 testator}{\i\insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 in the business worl}{ \insrsid2112869\charrsid8803012 d. }{\insrsid8332467\charrsid8803012 On}{\insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 the}{\insrsid2112869\charrsid8803012 contrary D}{\insrsid8332467\charrsid8803012 W2 go}{ \insrsid2112869\charrsid8803012 t }{\insrsid8332467\charrsid8803012 married}{\insrsid2112869\charrsid8803012 away in Kampala. She was }{\insrsid8332467\charrsid8803012 not}{\insrsid2112869\charrsid8803012 involved in the busines}{ \insrsid8332467\charrsid8803012 s enterprises here in Fort Portal DW}{\insrsid2112869\charrsid8803012 3}{\i\insrsid2112869\charrsid8803012 }{\insrsid8332467\charrsid8803012 was also}{\insrsid2112869\charrsid8803012 a Shop assistant }{ \insrsid8332467\charrsid8803012 of}{\insrsid2112869\charrsid8803012 Savanah Enterprises in Entebbe. She }{\insrsid8332467\charrsid8803012 had no han}{\insrsid2112869\charrsid8803012 d in the }{\insrsid8332467\charrsid8803012 running of th}{ \insrsid2112869\charrsid8803012 e many business }{\insrsid8332467\charrsid8803012 enterprises}{\insrsid2112869\charrsid8803012 in and }{\insrsid8332467\charrsid8803012 around }{\insrsid2112869\charrsid8803012 Fort}{\insrsid8332467\charrsid8803012 P}{ \insrsid2112869\charrsid8803012 ortal}{\insrsid2894007\charrsid8803012 . I}{\insrsid2112869\charrsid8803012 very much doubt }{\insrsid2894007\charrsid8803012 whether she ever discussed any }{\insrsid2112869\charrsid8803012 matter with th}{ \insrsid2894007\charrsid8803012 e}{\insrsid2112869\charrsid8803012 }{\insrsid2894007\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 }{\insrsid2894007\charrsid8803012 concerning the making the alleged Will of}{\insrsid2112869\charrsid8803012 }{\insrsid2894007\charrsid8803012 1988. \par }{\insrsid2112869\charrsid8803012 In the end I endorse the submission }{\insrsid2894007\charrsid8803012 of}{\insrsid7231628 Mr. Mugamba that the }{\insrsid2894007\charrsid8803012 testator\rquote s}{\insrsid2112869\charrsid8803012 }{ \insrsid2894007\charrsid8803012 will dated 10}{\super\insrsid2894007\charrsid8803012 th}{\insrsid2894007\charrsid8803012 }{\insrsid2112869\charrsid8803012 May 1985}{\i\insrsid2112869\charrsid8803012 }{\insrsid2894007\charrsid8803012 was a valid one and I so}{\insrsid2112869\charrsid8803012 I }{\insrsid2894007\charrsid8803012 hold}{\insrsid2112869\charrsid8803012 . So the first issue is theref}{\insrsid2894007\charrsid8803012 ore answered to affirmatively. \par }{\insrsid2112869\charrsid8803012 And I now}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 turn to}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 the second issue whether the Plaintiff}{ \insrsid2894007\charrsid8803012 (P}{\insrsid2112869\charrsid8803012 W.5) and four }{\insrsid2894007\charrsid8803012 others}{\insrsid9907337\charrsid8803012 were fit and proper persons fo}{\insrsid2112869\charrsid8803012 r the grant }{ \insrsid9907337\charrsid8803012 of}{\insrsid7231628 probate. }{\insrsid9907337\charrsid8803012 According to DW1, DW}{\insrsid2112869\charrsid8803012 2 and D}{\insrsid9907337\charrsid8803012 W}{\insrsid2112869\charrsid8803012 3}{ \i\insrsid9907337\charrsid8803012 , }{\insrsid9907337\charrsid8803012 P}{\insrsid2112869\charrsid8803012 W.5}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 could not properly look after the }{\insrsid9907337\charrsid8803012 testator \rquote s}{\insrsid2112869\charrsid8803012 estate simply because she was married woman. }{\insrsid9907337\charrsid8803012 She}{\insrsid2112869\charrsid8803012 was }{\insrsid9907337\charrsid8803012 go}{\insrsid2112869\charrsid8803012 ing to mix her marital affairs with those }{\insrsid9907337\charrsid8803012 of}{\insrsid2112869\charrsid8803012 the Estate. She was accused }{\insrsid9907337\charrsid8803012 of not being abl}{\insrsid2112869\charrsid8803012 e look after the widows and the children left behind by the deceased }{\insrsid9907337\charrsid8803012 brothers.}{\insrsid2112869\charrsid8803012 She }{\insrsid9907337\charrsid8803012 was further accused of being un-}{\insrsid2112869\charrsid8803012 cooperative with the rest of the children. They accused the }{\insrsid9907337\charrsid8803012 se}{\insrsid2112869\charrsid8803012 co}{\insrsid9907337\charrsid8803012 nd and third executors that is; Dr}{\insrsid2112869\charrsid8803012 u}{ \insrsid9907337\charrsid8803012 scilla Nyaka}{\insrsid2112869\charrsid8803012 ana the first official wife of the }{\insrsid9907337\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 and Katalina Nyaka}{\insrsid9907337\charrsid8803012 a}{ \insrsid2112869\charrsid8803012 na the mother of }{\insrsid9907337\charrsid8803012 PW}{\insrsid2112869\charrsid8803012 .5}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 of being senile and too aged }{\insrsid9907337\charrsid8803012 to loo}{\insrsid2112869\charrsid8803012 k after the }{\insrsid9907337\charrsid8803012 estate. The}{\insrsid2112869\charrsid8803012 y were aged }{\i\insrsid2112869\charrsid8803012 75 }{\insrsid9907337\charrsid8803012 and 70 years respectively. \par }{\insrsid2112869\charrsid8803012 Th}{\insrsid9907337\charrsid8803012 e}{\insrsid2112869\charrsid8803012 third executor }{\insrsid9907337\charrsid8803012 appointed in the W}{\insrsid2112869\charrsid8803012 ill was Sam Kiiza was }{ \insrsid9907337\charrsid8803012 referred to by DW3, DW2 and DW1 as a person of unsound mind whereas Kahuma a Senior Six Student was referred to as a minor and could not. }{\insrsid2112869\charrsid8803012 D}{\insrsid9907337\charrsid8803012 W}{ \insrsid2112869\charrsid8803012 1, D}{\insrsid9907337\charrsid8803012 W}{\insrsid2112869\charrsid8803012 2 }{\insrsid9907337\charrsid8803012 and DW}{\insrsid2112869\charrsid8803012 3 }{\insrsid9907337\charrsid8803012 suggested}{ \insrsid2112869\charrsid8803012 that the }{\insrsid9907337\charrsid8803012 children}{\insrsid2112869\charrsid8803012 }{\insrsid9907337\charrsid8803012 could}{\insrsid2112869\charrsid8803012 meet and choose among themselves }{ \insrsid9907337\charrsid8803012 who}{\insrsid2112869\charrsid8803012 could be granted letters of }{\insrsid9907337\charrsid8803012 Administrations}{\insrsid3218059\charrsid8803012 to the Estate of}{\insrsid2112869\charrsid8803012 the Late Nyak}{ \insrsid3218059\charrsid8803012 a}{\insrsid2112869\charrsid8803012 ana the }{\insrsid3218059\charrsid8803012 testator}{\insrsid2112869\charrsid8803012 . }{\insrsid3218059\charrsid8803012 The}{\insrsid2112869\charrsid8803012 case for }{ \insrsid3218059\charrsid8803012 the plaintiff}{\insrsid2112869\charrsid8803012 was that she }{\insrsid3218059\charrsid8803012 was assisting the children of her deceased }{\insrsid2112869\charrsid8803012 brothers by paying their school fees maintaining them and that the rest of the executors were capable of looking after}{\insrsid3218059\charrsid8803012 the estate together with her. \par }{\insrsid2112869\charrsid8803012 Under section 181 of the Succession Act Cap 139, Probate can be granted only to an executor }{\insrsid3218059\charrsid8803012 appointed by the kill and under}{\insrsid7231628 S}{\insrsid2112869\charrsid8803012 . }{ \insrsid3218059\charrsid8803012 1}{\insrsid2112869\charrsid8803012 83 of the same Act probate}{\i\insrsid2112869\charrsid8803012 }{\ul\insrsid2112869\charrsid8803012 shall not be granted }{\insrsid2112869\charrsid8803012 to any }{ \insrsid3218059\charrsid8803012 person}{\insrsid2112869\charrsid8803012 who is }{\insrsid14174764\charrsid8803012 a minor or is of unsound mind. W.5 though married woman i}{\insrsid14174764\charrsid8803012 s}{\insrsid13977535\charrsid8803012 not precluded from being ap}{\insrsid2112869\charrsid8803012 pointed as an executor to the}{ \insrsid13977535\charrsid8803012 estate of the late Nyakaana the testator, similarly both Druscilla}{\insrsid2112869\charrsid8803012 }{\insrsid13977535\charrsid8803012 Nyakaana}{\insrsid2112869\charrsid8803012 a}{\insrsid13977535\charrsid8803012 nd Katal}{\insrsid2112869\charrsid8803012 i}{\insrsid13977535\charrsid8803012 na Ny}{\insrsid2112869\charrsid8803012 aka}{\insrsid13977535\charrsid8803012 ana though the}{\insrsid2112869\charrsid8803012 y are apparently aged the law }{ \insrsid13977535\charrsid8803012 does not sto}{\insrsid2112869\charrsid8803012 p t}{\insrsid4334020\charrsid8803012 hem from b}{\insrsid2112869\charrsid8803012 eing}{\insrsid4334020\charrsid8803012 appointed as executors to the E}{ \insrsid2112869\charrsid8803012 state of the Late Nyakaana the }{\insrsid4334020\charrsid8803012 deceased. \par }{\insrsid2112869\charrsid8803012 With regard}{\i\insrsid2112869\charrsid8803012 }{\insrsid4334020\charrsid8803012 to Sam Kiiza DW1, DW}{\insrsid2112869\charrsid8803012 2, and DW3 all refer to him a}{\insrsid4334020\charrsid8803012 s a man of unsound mind, P. W.5 o}{\insrsid2112869\charrsid8803012 n the other hand testi}{\insrsid4334020\charrsid8803012 fied in court here that the said}{\insrsid2112869\charrsid8803012 Kiiz}{\insrsid4334020\charrsid8803012 a}{ \insrsid2112869\charrsid8803012 was normal pers}{\insrsid4334020\charrsid8803012 on. He had a family and children an}{\insrsid2112869\charrsid8803012 d th}{\insrsid4334020\charrsid8803012 at they have been carrying o}{\insrsid2112869\charrsid8803012 n }{ \insrsid4334020\charrsid8803012 some}{\insrsid2112869\charrsid8803012 bu}{\insrsid4334020\charrsid8803012 s}{\insrsid2112869\charrsid8803012 i}{\insrsid4334020\charrsid8803012 ness together. The lear}{\insrsid2112869\charrsid8803012 ne}{ \insrsid4334020\charrsid8803012 d counsel representing the defen}{\insrsid2112869\charrsid8803012 dant submitted that Kiiza was a mad}{\insrsid4334020\charrsid8803012 }{\insrsid2112869\charrsid8803012 man and that }{\insrsid4334020\charrsid8803012 PW5 frustrated the efforts}{\insrsid2112869\charrsid8803012 of th}{\insrsid4334020\charrsid8803012 e defence}{\insrsid2112869\charrsid8803012 }{\insrsid4334020\charrsid8803012 when they wanted to call}{\insrsid2112869\charrsid8803012 in as a defence witness and test his normality. That Kiiza}{\insrsid7689382\charrsid8803012 went outside the court building and was followed by PW}{\insrsid8208847 .5 }{\insrsid7689382\charrsid8803012 who stopped him from returning to court. \par }{\insrsid2112869\charrsid8803012 The learned counsel further submitted that the said P. W.5 further interfered with the witness }{\insrsid7689382\charrsid8803012 summonses when they tried to summon him as a witness for the defence. The Court on its own motion}{\insrsid8208847 }{\insrsid2112869\charrsid8803012 recalled P. W.5 in order to clarify }{\insrsid7689382\charrsid8803012 the allegations }{ \insrsid2112869\charrsid8803012 that \line she was not responsi}{\insrsid7689382\charrsid8803012 ble for the disappearance of Kiiza on the date the defence}{\insrsid2112869\charrsid8803012 want}{\insrsid7689382\charrsid8803012 to call h}{ \insrsid2112869\charrsid8803012 im}{\insrsid7689382\charrsid8803012 as}{\insrsid2112869\charrsid8803012 it}{\insrsid7689382\charrsid8803012 s}{\i\insrsid2112869\charrsid8803012 }{\insrsid7689382\charrsid8803012 witnesses}{ \insrsid2112869\charrsid8803012 . That it }{\insrsid7689382\charrsid8803012 was coincident}{\i\insrsid2112869\charrsid8803012 }{\insrsid8208847 that }{\insrsid7689382\charrsid8803012 Kiiza went}{\insrsid2112869\charrsid8803012 out and she followed him and when she returned to the court Hall}{\insrsid204614\charrsid8803012 Kiiza also returned to the court and eventually went away on }{\insrsid2112869\charrsid8803012 his own. She did not talk to him. On the allegations that she interfe}{\insrsid204614\charrsid8803012 red with the witness summons PW}{\insrsid2112869\charrsid8803012 5 clarified that she stays at Harukoto Village whereas Kiiza stayed at Mirongo a distance of about 30 miles apart }{\insrsid204614\charrsid8803012 however}{\insrsid2112869\charrsid8803012 , the affidavit or }{\insrsid204614\charrsid8803012 Process}{ \insrsid2112869\charrsid8803012 Server was to the effect }{\insrsid204614\charrsid8803012 that}{\insrsid2112869\charrsid8803012 the }{\insrsid204614\charrsid8803012 said}{\insrsid2112869\charrsid8803012 Kiiza had been }{\insrsid204614\charrsid8803012 hospitalized}{\insrsid2112869\charrsid8803012 at Kagadi and service}{\insrsid204614\charrsid8803012 could not be effected on him. }{\insrsid2112869\charrsid8803012 From what p. W.5 clarified when recalled I}{\i\insrsid2112869\charrsid8803012 }{ \insrsid2112869\charrsid8803012 was satisfied that she did not in any way stop Sam Kiiza from coming to testify in }{\insrsid204614\charrsid8803012 court}{\insrsid2112869\charrsid8803012 and at the same time there }{\insrsid204614\charrsid8803012 was no evidence before me to on }{\insrsid2112869\charrsid8803012 hi}{\insrsid204614\charrsid8803012 m. \par From what PW5 clarified when recalled I was satisfied that she did not in any way stop Sam Kiiza from coming to }{\insrsid6890774\charrsid8803012 testifying court and at the same time there was no eviden ce before me to conclude that Kiiza was a man of unsound mind. As I said I believe PW5, she told this court the truth}{\insrsid2112869\charrsid8803012 }{\i\insrsid2112869\charrsid8803012 \par }\pard\plain \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14705663 \fs24\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 {\insrsid6890774\charrsid8803012 So Kiiza}{\insrsid2112869\charrsid8803012 could also he granted pr}{\insrsid6890774\charrsid8803012 obate to the Estate of Late Nyakaana. \line Kahum}{\insrsid2112869\charrsid8803012 a on the other hand was a minor and still }{\insrsid6890774\charrsid8803012 he is and as such he is preclud}{ \insrsid2112869\charrsid8803012 ed from grant of }{\insrsid6890774\charrsid8803012 probate}{\insrsid2112869\charrsid8803012 by the law of this country. He is thereby barred from acting as executor to the estate of the }{\insrsid6890774\charrsid8803012 testator the Late Ezira Binondo Nyakaana. He could not prove the probate. \par \par }{\insrsid2112869\charrsid8803012 In the end it is the }{\insrsid6890774\charrsid8803012 considered}{\insrsid2112869\charrsid8803012 opinion of the court that the plaintiff }{\insrsid6383356\charrsid8803012 had}{\insrsid2112869\charrsid8803012 proved her clai}{\insrsid6383356\charrsid8803012 m on a balance of probabilities.}{\insrsid2112869\charrsid8803012 }{\insrsid6383356\charrsid8803012 In}{\insrsid2112869\charrsid8803012 }{\insrsid6383356\charrsid8803012 the}{ \insrsid2112869\charrsid8803012 result }{\insrsid6383356\charrsid8803012 the}{\insrsid2112869\charrsid8803012 Caveat lodged by }{\insrsid6383356\charrsid8803012 that}{\insrsid2112869\charrsid8803012 defendant against the grant of }{ \insrsid6383356\charrsid8803012 probate}{\insrsid2112869\charrsid8803012 to }{\insrsid6383356\charrsid8803012 the}{\insrsid2112869\charrsid8803012 }{\insrsid6383356\charrsid8803012 plaintiff (PW5),}{\i\insrsid2112869\charrsid8803012 }{ \insrsid2112869\charrsid8803012 Druscilla Nyakaana, Katalina Ny}{\insrsid6383356\charrsid8803012 a}{\insrsid2112869\charrsid8803012 ka}{\insrsid6383356\charrsid8803012 ana}{\insrsid2112869\charrsid8803012 and Sam Kiiza is thereby annulled and removed and the said, executors should proce}{\insrsid6383356\charrsid8803012 ed and be granted the probate. \par \par }{\insrsid2112869\charrsid8803012 The plaintiff prayed for general }{\insrsid6383356\charrsid8803012 damages}{\insrsid2112869\charrsid8803012 .}{\i\insrsid2112869\charrsid8803012 }{\insrsid2112869\charrsid8803012 These are the damages which the law treats as the natural consequences of the wrong done to the plaintiff and injury she thereby suffered.
