He continued that Betty Nalumaga is suing in her capacity as an Administrator of the estate of her late daughter Margaret Nampiima deceased. Later letters of administration were granted to her under administration cause No. 306/94. Betty Naluma ga is claiming an interest in this estate of her daughter who claimed interest in the estate of her father Sam Kulubya the deceased. Margaret\rquote s claim was made in the High Court of Uganda and when the matter went to the Supreme Court Civil Appeal No. 15 of 1990 whereby Serwano Kulubya was the appellant and Margaret Nampiima the respondent, her claim was rejected and the court ruled that she had no interest in the estate of Kulubya particularly plot 1 5 situated on Nakivubo place/road commonly known as Kulubya place. It is apparent from the plaint and judgment of the Supreme Court the plaintiff is trying to resurrect the matter which was finally adjudicated upon by the Supreme Court. \par The matter is now resjudicate and the effort to resurrect it will be an abuse of court process. He submitted that Betty Nalumaga had no locus standi to make a claim in the administration of the estate of Sam Kul ubya the deceased. She purports to hold letters of administration in respect of her daughter\rquote s estate whereas the claim by her late daughter in the estates of Sam Kulubya was dismissed by the Supreme Court. To maintain that there is a cause of act ion she must show that her rights had been violated by the defendant and in the circumstances since there are no rights enjoyed by her in the suit property her claim ought not to be maintained. He further submitted that the plaintiff was a foreigner to the estate of the late Kulubya. She could not even question the management of the estate. The plaint should be struck out and the claim dismissed as being vexations frivolous and misplaced. Lubega counsel for the plaintiff submitted that there was a number of legal issues raised and would answer them in the order pres ented. The first being whether the plaint disclosed a cause of action. It is trite law that if the court is to enquire whether a plaint discloses a cause of action, it has only to look at the plaint. The plaintiff had disclosed grounds why he was bringing the action. She was aggrieved by the fact that the property known as plot 15 Nakivubo Road, Kulubya house which was given to her daughter as a gift made intervivos has not been honoured by the defendant who are executors }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15035207\charrsid622078 of the will of her father Sam K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ulubya, that i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15035207\charrsid622078 s clearly brought in paragraph 4}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 of the plaint which elaborates her areas of discontent and hence the cause of action. The remedies which the plaintiff is seeking from the court are quite clear and particularly a declaration as t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15035207\charrsid622078 o ownership of that plot to No.15 Kulubya house.

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 The plaintiff\rquote s pleadings have clearly disclosed a cause of action and over which she is seeking the Honourable}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15035207\charrsid622078 Court to determine her right. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 On the second preliminary point that the plaintiff }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15035207\charrsid622078 did not have the locus standi he}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 submitted that the plai}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 ntiff had disclosed under para 4}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 (c) of the plaint that she is the administrator of the estate of her daughter Margaret Nampiima and that was granted under }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 Administion Cause}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 N}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 o.306 of 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 994 granted by the High Court. It is by virtue of this grant that the plaintiff has } {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 stepped in the shoes of her}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 late daughter to pursue the gift that she had got from her late father called }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 Sam}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 Kulubya. Nampiima\rquote s rights have not abated. They are very much still alive and the plaintiff was clothed with the necessary grant to pursue them. She has to pursue }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 on}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 behalf}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 \line of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 gift made to her intervivos by her late father. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 On the third point raised by his learned friend was the doctrine of resjudicate. He looked at the plaint filed in respect of this matter which went on appeal to the Supreme Court. The matter came to court under Misc. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16546502\charrsid622078 case No. 41}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 /9 whereby the defendants in the case were the applicants and the late Nampiima Margaret was the respondent. That case was brought by the applicants to show cause why a caveat she had lodged on the suit property plot 15 should not be removed. The main issue for the court to determine was whe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 ther the letter under which Nam}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 piima\rquote }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 s father late K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ulubya had given property to her was a codicil or not. The Hon. Judge decided the matter in her favour and decreed the property to her. On appeal Civil Appeal No. }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 15}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid16130543\charrsid622078 /}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 90}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid16130543\charrsid622078 , }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 the Hon.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 Judge\rquote s judgment was on the basis that the letter }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 bequeathing}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 property to her was not a codicil. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 The Supreme Court did not go into the issue of the ownership because right from the High Court that matter had not been presente}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 d }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 to the court for determination. The learned Judge declined to deal with the matter. The question then before the court is whether the matter concerning plot No. 15 is resjudicate or not. He submitted further that he had the opportunity to peruse Semakula\rquote s case ab}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 ove. The test that was used in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 that case to determine the doctrine of resjudicate in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 his view was the proper test. He}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 invited court to look at the pleadings. The plain}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 tiff is not going around to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 resurrect a matter that has been clearly closed. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 In the former case which went to the Supreme Court the issue for determination was whether the caveat was to be vacated or not and nothing more. The question of whether the plaintiff is entitled now as Administrator to the estate plot}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 No. 15 Nakivub}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 o Road was never tackled. So the court has the jurisdiction to enquire in it. I was referred to the case of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \b\insrsid11416535\charrsid622078 Karsani . V. Bhogal 1953 20 EACA P.74}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 where the court held }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 that matter in issue }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 does not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 mean any matter in issue but the entire subject in controversy. He submitted that the Supreme Court was called upon to determine only one issue the caveat. The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 controversy surrounding the ownership of the property had}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 not been resolved. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 This Hon. Court is being called upon to decide whether gift }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 intervivos}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 supersedes}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 an earlier view and whether this gift }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 intervivos}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 is valid or not, and whether it is testamentary disposition or not. The learned counsel invited this court to hold that the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 doctrine}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 of resjudicate is not applicable and at the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 same time}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 , the institution of this case is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 not an abuse of court process. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 As to whether the case was frivolous and vexations he submitted that his learned friend failed to prove in which areas }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 the}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 plaint is frivolous or }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 vexatious}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 . The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 has as the Administrator of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 Ma}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 rgaret Nampiima to call upon the Administrator to the estate of her late father to render an account to how th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 ey have administered the estate.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 He prayed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 that the court ignores the preliminary point of law }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 and se}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 t the suit for proper hearing }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 and}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11416535\charrsid622078 he}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 also prayed that Misc.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 Ca}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 use No. 41}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 /}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 9 be ava}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 iled to the court for perusal. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 In reply Mr. Winyi counsel appearing for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 defendant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 submitted that counsel had misled the court that the matter settled in the Supreme Court was a question of caveat only. The Supreme Court was to determine whether or not a letter written by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 Ku}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 lubya not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 witnessed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 amounted to codicil. From the record here and in the Supreme Court that Sam Kulubya died testate and in his will did not name Nampiima as her daughter and not even }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 bequeathed any property to her.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 Nampiima came to court with a letter alleging came from Kulubya. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 The High Court ruled that the le}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 tter amounted to a codicil and that sh}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 e was entitled to plot No. 15 K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ulubya House but when the matter sent to the Supreme Court the judgment was rejected and the court found }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 that the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 letter was not a codicil with the view that she was ordered to remove a caveat she had lodged. Now }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 the matter is being re-dragge}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 d to court which is not proper and this is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 resjudicate}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 . Nalumaga cannot come around and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 claim through her daughter wh}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ich claim was dismissed b}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 y the Supreme Court. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 He finally submitted as pointed out in the Karsan\rquote s case by his learned friend that the entire controversy must be dealt with and this hinges on the letter which was never in the will of the late }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ulubya. The ruling was on caveat. \line It is not correct to say that the court would be called upon t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 o decide }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 whether the codicil supersedes the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 earlier will, the doctrine of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 resjudicate is relevant here and prayed that the preliminary }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16008521\charrsid622078 objection be uphe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 ld. \par I had the occasion}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 to peruse the rec}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 ords of this court in Misc. Appl. No. 41}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 /}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 9 and of course the plaint in this case. I }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 also}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 considered the forceful submissions of the learned couns}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 els.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 The issues upon which decis}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 ions are being sought are three. One, whether }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 the plaint discloses a cause of action and the second issue is whether the plaintiff had the locus }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 standi in this case and finally}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 whether the matter is resjudicate. I will deal with the issues in their nume}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1578475\charrsid622078 rical order as outlined above. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 As to whether the plaint discloses a cause of action. K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ulubya who is also deceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 . That the late Samuel Kulubya left a will appointing}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 his mother, his father plus the two defendants as the executors of the will. It is further shown in the will that the late Samuel Kulubya left various portions of land which included plot 15 Nakivubo Road. It is alleged that the said gift intervivos given to the late Nampiima Margaret }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 but it was alleged that the defendants}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 had chosen to ignore the grant and hence this suit. I am of the view that the plaint disclosed }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 a cause}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 of action whether plot 15 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 K}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 ulubya place was a gift inter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 vivos given to the late Nampiim}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 a Margaret and the plaintiff who }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 was}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 granted letters of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 administration}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 was in the shoes of her daughter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 could}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 bring the action }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 against the defendant.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 She had that right which was violated by the defendants and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5663345\charrsid622078 they we}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16130543\charrsid622078 re liable. So even if I may be wrong in that the cause of action was different but the question of ownership of plot 15 Nakivubo was never finally adjudicated upon.
