The court held that the judgment debtor, having attended a Commission of Inquiry as a party to an election petition, was protected from civil arrest under section 86(2) of the Civil Procedure Ordinance while returning home from the proceedings. The protection afforded to witnesses and parties extends to proceedings under the Commissions of Inquiry Ordinance, as they are granted the same privileges as those before the Supreme Court. The arrest was therefore unlawful, as the debtor was entitled to exemption from arrest during his return from the inquiry.
