Procedural Posture

Miscellaneous Criminal Application / Bail Application Ruling

  1. 1 Whether the applicants are entitled to bail pending trial for murder.
  2. 2 Whether exceptional circumstances exist to justify release on bail.
  3. 3 Whether the applicants' continued detention violates their constitutional rights.

Ratio Decidendi

The court found that, despite the applicants' prolonged remand and the bailable nature of the offence, the gravity of the murder charge, the circumstances surrounding the alleged commission of the offence, and the risk of mob justice and flight outweighed the applicants' arguments for bail. The court held that this was not a proper case to disregard the requirement of proving exceptional circumstances. Furthermore, the imminent commencement of the criminal session for their trial rendered further delay moot. Accordingly, the application for bail was dismissed and the applicants were ordered to remain on remand until further orders.
