Ratio Decidendi

The court found that the applicant failed to demonstrate any mistake or error apparent on the face of the record in the ruling of 30th November 2023. The applicant's financial incapacity and employment status were not triable issues in the original motion, and the consequential orders were based on the judgment in Civil Appeal No. 32 of 2022. The alleged new evidence and circumstances required examination of facts and evidence, which is outside the scope of review under Order 46. The application did not raise any issue that called for review, and the court declined to sit as an appellate court to re-examine its own decision. The application was dismissed for lack of merit.
