Ratio Decidendi

The Plaintiffs failed to prove on a balance of probabilities that they were entitled to computation of their pension and gratuity based on salary scale U7 upper. The evidence did not establish that their salary scale was officially changed to U7 upper at the time of retirement, nor was there any appointment or notification to that effect. The payments made at U7 upper prior to retirement were found to be erroneous, and the Defendant's assessment of pension and gratuity at U8 lower was justified and in accordance with the law and guidance from the Ministry of Public Service. The Plaintiffs are not entitled to the remedies sought, and the suit is dismissed.
