The Court of Appeal found that the High Court trial was conducted in violation of the Civil Procedure Rules. The trial judge, upon taking over from a predecessor, ordered the parties to file affidavit evidence and proceeded to judgment without conducting an oral hearing or allowing cross-examination of witnesses. This procedure was not authorized by law, as Order 18 of the Civil Procedure Rules requires that evidence be taken orally in open court, and Order 19 only permits affidavit evidence for particular facts, not for the entirety of a trial where cross-examination is necessary.
