The court found that although the suit from which the application arose had been disposed of and was at the execution stage, the applicant, as administrator of the estate of the late Benjamin Buchunju, had a legitimate interest in being substituted as defendant and respondent. The court held that Order 24 Rule 4(1) of the Civil Procedure Rules allows substitution where a defendant dies during a pending suit and the cause of action survives. The interlocutory judgment did not terminate the suit, and the final judgment was entered after the death of the defendant.
