The plaintiffs' suit is barred by res judicata, as the issues of ownership, interest, and alleged destruction on the suit land were conclusively determined in Civil Suit No.38/2012, which declared the estate of Herbert Rwakiswaza Kimera (predecessor in title to the 1st defendant) as lawful owner and dismissed the plaintiffs' claims as trespassers. The present defendant, as transferee, is bound by the judgment in rem. The plaintiffs failed to adduce credible evidence of destruction or loss attributable to the defendant, and their photographic and valuation evidence was found unreliable and of no probative value.
