The court found that the Applicants' allegations of fraud, which formed the basis for seeking to set aside the consent judgment, were serious and required a higher standard of proof than what could be established through affidavit evidence in a motion. The court held that such allegations should be determined in an ordinary suit where evidence can be tested under cross-examination, not by motion. The Applicants failed to discharge the burden and standard of proof required to establish fraud. Consequently, the application to set aside the consent judgment was found to be improper and was dismissed.
