Ratio Decidendi

The Applicants failed to comply with the Court's directive to serve the Respondents with the application. Service of hearing notices alone does not satisfy the requirement for service of the application itself. Such non-compliance constitutes an abuse of Court process, as parties seeking justice must themselves act justly and follow procedural rules. The absence of service deprived the Respondents of an opportunity to respond, undermining the fairness of proceedings. The application is therefore dismissed for non-service under Order 5 Rule 3(1)(a) of the Civil Procedure Rules.
