Miscellaneous Application / Ruling on Bail Application

  1. 1 Whether the applicants are entitled to bail pending trial for the offence of murder.
  2. 2 Whether the applicants have demonstrated exceptional circumstances warranting grant of bail.
  3. 3 Whether the applicants present a risk of absconding or interfering with investigations.

Ratio Decidendi

The court found that while the applicants have a constitutional right to apply for bail and presented substantial sureties and proof of residence, they failed to demonstrate any exceptional circumstances as required for grave offences such as murder. The court emphasized that the discretion to grant bail must be exercised judiciously and only where the applicant presents facts beyond ordinary considerations. Given the gravity of the offence, the gruesome manner of the alleged murder, and the high risk of absconding, the court was not satisfied that this was a suitable case for the exercise of its discretion to grant bail. Consequently, bail was denied and the application dismissed.
