The claimant, appointed as Head of Procurement and Disposal Unit by the Board, held a managerial position. Under Clause 8.1 of the Human Resource Manual, disciplinary control over managerial staff is vested in the Board, not the Executive Director. The Executive Director’s unilateral termination of the claimant was ultra vires and unlawful, as the claimant was not afforded an opportunity to be heard by the Board. The respondent failed to prove that the claimant was in a non-managerial position. Consequently, the termination was unlawful. The claimant is entitled to general damages for loss of income and self-esteem, and severance pay calculated as one month’s salary per year of service....
