The trial chief magistrate exercised jurisdiction with material irregularity by dismissing both the application for leave to appear and defend and the main suit for want of prosecution, despite the parties having complied with their procedural obligations by filing pleadings and submissions. The magistrate should have determined the application on its merits, as the parties had discharged their duty as litigants. The failure to do so occasioned a miscarriage of justice, warranting the High Court's intervention under section 83 of the Civil Procedure Act. Accordingly, the decision of the trial chief magistrate is set aside, and both matters are reinstated to be determined on their merits.
