Ratio Decidendi

The court found that the letters of administration granted to Dafroza Babihenkomo in respect of the estate of Narcisio Ndakwenda had become inoperative due to her death in 2019, and thus revoked the grant pursuant to Section 234(2) of the Succession Act. However, the court declined to appoint the Applicant as sole administrator, noting that his fitness was contested and could not be determined through this application. The proper procedure for appointment must be followed, allowing for objections and a full hearing. The application therefore succeeded only in part: the previous grant was revoked, but no new administrator was appointed.
