The Plaintiff established, through uncontroverted evidence, that the Respondents obtained and defaulted on two loan facilities secured by a mortgage over Kyadondo Block 214 Plot 1385. Notices of default and sale were properly served, and the Respondents failed to remedy the default or contest the proceedings. Under the Mortgage Act, the Plaintiff is entitled to foreclose and sell the mortgaged property by public auction, not by private treaty, as the law prescribes public auction as the default method unless the mortgagor consents otherwise.
